14 On page 6, between lines 14 and 15,

16 insert:
17 Section 2. When the Public Service Commission
18 initiates an agency action affecting the substantial interest
19 of a utility regulated under chapter 367, Florida Statutes,
20 concerning any matter pertaining to section 120.60(5), Florida
21 Statutes, and a formal administrative hearing is requested
22 under section 120.57, Florida Statutes, the commission may
23 refer the matter to the Division of Administrative Hearings
24 for the assignment of an administrative law judge to conduct
25 the hearing and enter a recommended order.
