15 On page 25, between lines 634-635,

17 insert:
18 Section 9. Paragraph (a) of subsection (3A NAME="Page1Line19">19 subsection (9) of section 202.19, Florida Statutes, are
20 amended to read:
21 202.19 Authorization to impose local communications
22 services tax.--
23 (3)(a) The tax authorized under this section includes
24 and is in lieu of any fee or other consideration, including,
25 but not limited to, application fees, transfer fees, renewal
26 fees, or claims for related costs, to which the municipality
27 or county is otherwise entitled for granting permission to
28 dealers of communications services, including, but not limited
29 to, providers of cable television services, as authorized in
30 47 U.S.C. s. 542, to use or occupy its roads or rights-of-way
31 for the placement, construction, and maintenance of poles,

1 wires, and other fixtures used in the provision of
2 communications services.
3 (9) The revenues raised by any tax imposed under
4 subsection (1) or s. 202.20(1), or distributed to a local
5 government pursuant to s. 202.18, may be used by a
6 municipality or county for any public purpose, including, but
7 not limited to, pledging such revenues for the repayment of
8 current or future bonded indebtedness. Revenues raised by a
9 tax imposed under subsection (5) shall be used for the same
10 purposes as the underlying discretionary sales surtax imposed
11 by the county or school board under s. 212.055.

20 insert:
21 amending s. 202.19, F.S.; clarifying a
22 characterization of the local communications
23 services tax as including certain fees and
24 being in lieu of such fees; authorizing
25 municipalities or counties to use certain
26 revenues distributed to a local government for
27 certain purposes;
