1 A bill to be entitled
2 An act relating to the Florida KidCare program;
3 amending s. 409.8132, F.S.; providing for
4 year-round enrollment in the Medikids program
5 component of the Florida KidCare program;
6 amending s. 409.8134, F.S.; providing for
7 year-round enrollment in the Florida KidCare
8 program; providing an effective date.

10 Be It Enacted by the Legislature of the State of Florida:

12 Section 1. Subsection (7) of section 409.8132, Florida
13 Statutes, is amended to read:
14 409.8132 Medikids program component.--
15 (7) ENROLLMENT.--Enrollment in the Medikids program
16 component may only occur at any time throughout the year
17 during periodic open enrollment periods as specified in s.
18 409.8134. A child may not receive services under the Medikids
19 program until the child is enrolled in a managed care plan or
20 MediPass. Once determined eligible, an applicant may receive
21 choice counseling and select a managed care plan or MediPass.
22 The agency may initiate mandatory assignment for a Medikids
23 applicant who has not chosen a managed care plan or MediPass
24 provider after the applicant's voluntary choice period ends.
25 An applicant may select MediPass under the Medikids program
26 component only in counties that have fewer than two managed
27 care plans available to serve Medicaid recipients and only if
28 the federal Health Care Financing Administration determines
29 that MediPass constitutes "health insurance coverage" as
30 defined in Title XXI of the Social Security Act.

1 Section 2. Subsection (2) of section 409.8134, Florida
2 Statutes, is amended to read:
3 409.8134 Program enrollment and expenditure
4 ceilings.--
5 (2) Upon a unanimous recommendation by representatives
6 from each of the four Florida KidCare administrators, The
7 Florida KidCare program may conduct an open enrollment at any
8 time throughout the year period for the purpose of enrolling
9 children eligible for all program components listed in s.
10 409.813 except Medicaid. The four Florida KidCare
11 administrators shall work together to ensure that the
12 year-round open enrollment period is announced statewide at
13 least 1 month before the open enrollment is to begin. Eligible
14 children shall be enrolled on a first-come, first-served basis
15 using the date the open enrollment application is received.
16 The potential open enrollment periods shall be January 1st
17 through January 30th and September 1st through September 30th.
18 Open Enrollment shall immediately cease when the enrollment
19 ceiling is reached. Year-round An open enrollment shall only
20 be held if the Social Services Estimating Conference
21 determines that sufficient federal and state funds will be
22 available to finance the increased enrollment through federal
23 fiscal year 2007. Any individual who is not enrolled,
24 including those added to the waiting list after March 11,
25 2004, must reapply by submitting a new application during the
26 next open enrollment period. However, the Children's Medical
27 Services Network may annually enroll up to 120 additional
28 children based on emergency disability criteria outside of the
29 open enrollment periods, and the cost of serving these
30 children must be managed within the KidCare program's
31 appropriated or authorized levels of funding. Except for the

1 Medicaid program, whenever the Social Services Estimating
2 Conference determines that there are is presently, or will be
3 by the end of the current fiscal year, insufficient funds to
4 finance the current or projected enrollment in the Florida
5 KidCare program, all additional enrollment must cease and
6 additional enrollment may not resume until sufficient funds
7 are available to finance such enrollment.
8 Section 3. This act shall take effect upon becoming a
9 law.

14 The committee substitute requires the KidCare principals to
announce year-round enrollment in the program and changes the
15 effective date to upon becoming a law.
