14 On page 1, between lines 28 and 29,

16 insert:
17 Section 1. Paragraph (a) of subsection (1) of section
18 112.011, Florida Statutes, is amended, and subsection (2) of
19 that section is reenacted to read:
20 112.011 Felons; removal of disqualifications for
21 employment, exceptions.--
22 (1)(a) Except as provided in s. 775.16 and this
23 paragraph, a person is shall not be disqualified from
24 employment by the state, any of its agencies or political
25 subdivisions, or any municipality solely because of a prior
26 conviction for a crime. However, A person may be denied
27 employment by the state, any of its agencies or political
28 subdivisions, or any municipality by reason of the prior
29 conviction for a crime if the crime was a felony or first
30 degree misdemeanor and directly related to the position of
31 employment sought. The state may not employ a person who has

1 been convicted of a violation of s. 794.011 or s. 800.04, or a
2 violation of a similar law in another jurisdiction.
3 (2)(a) This section shall not be applicable to any law
4 enforcement or correctional agency.
5 (b) This section shall not be applicable to the
6 employment practices of any fire department relating to the
7 hiring of firefighters. An applicant for employment with any
8 fire department with a prior felony conviction shall be
9 excluded from employment for a period of 4 years after
10 expiration of sentence or final release by the Parole
11 Commission unless the applicant, prior to the expiration of
12 the 4-year period, has received a full pardon or has had his
13 or her civil rights restored.
14 (c) This section shall not be applicable to the
15 employment practices of any county or municipality relating to
16 the hiring of personnel for positions deemed to be critical to
17 security or public safety pursuant to ss. 125.5801 and
18 166.0442.
