1 A bill to be entitled
2 An act relating to workforce education;
3 amending s. 1011.80, F.S.; allowing a workforce
4 education program conducted by a school
5 district to use the term "college" in the name
6 of the school that is the site of the program;
7 providing an effective date.

9 Be It Enacted by the Legislature of the State of Florida:

11 Section 1. Subsections (2) and (10) of section
12 1011.80, Florida Statutes, are amended to read:
13 1011.80 Funds for operation of workforce education
14 programs.--
15 (2) Any workforce education program may be conducted
16 by a community college or a school district. A workforce
17 education program conducted by a school district may use the
18 term "college" in the name of the school at which the program
19 is conducted., except that College credit in an associate in
20 applied science or an associate in science degree may be
21 awarded only by a community college;. however, if an associate
22 in applied science or an associate in science degree program
23 contains within it an occupational completion point that
24 confers a certificate or an applied technology diploma, that
25 portion of the program may be conducted by a school district
26 career center or workforce education college. Any instruction
27 designed to articulate to a degree program is subject to
28 guidelines and standards adopted by the State Board of
29 Education pursuant to s. 1007.25.
30 (10) A high school student dually enrolled under s.
31 1007.271 in a workforce education program operated by a

1 community college or school district career center or
2 workforce education college generates the amount calculated
3 for workforce education funding, including any payment of
4 performance funding, and the proportional share of full-time
5 equivalent enrollment generated through the Florida Education
6 Finance Program for the student's enrollment in a high school.
7 If a high school student is dually enrolled in a community
8 college program, including a program conducted at a high
9 school, the community college earns the funds generated for
10 workforce education funding, and the school district earns the
11 proportional share of full-time equivalent funding from the
12 Florida Education Finance Program. If a student is dually
13 enrolled in a career center or workforce education college
14 operated by the same district as the district in which the
15 student attends high school, that district earns the funds
16 generated for workforce education funding and also earns the
17 proportional share of full-time equivalent funding from the
18 Florida Education Finance Program. If a student is dually
19 enrolled in a workforce education program provided by a career
20 center or workforce education college operated by a different
21 school district, the funds must be divided between the two
22 school districts proportionally from the two funding sources.
23 A student may not be reported for funding in a dual enrollment
24 workforce education program unless the student has completed
25 the basic skills assessment pursuant to s. 1004.91.
26 Section 2. This act shall take effect July 1, 2005.
