14 On page 4, between lines 13 and 14,

16 insert:
17 Section 3. Subsection (47) of section 39.01, Florida
18 Statutes, is amended to read:
19 39.01 Definitions.--When used in this chapter, unless
20 the context otherwise requires:
21 (47) "Other person responsible for a child's welfare"
22 includes the child's legal guardian, legal custodian, or
23 foster parent; an employee of a private school, public or
24 private child day care center, residential home, institution,
25 facility, or agency; a law enforcement officer or employee of
26 a municipal or county detention facility or of the Department
27 of Corrections while acting in an official capacity, public
28 school volunteer, religious organization volunteer, health
29 care provider, or any other person legally responsible for the
30 child's welfare in a residential setting; and also includes an
31 adult sitter or relative entrusted with a child's care. For

1 the purpose of departmental investigative jurisdiction, this
2 definition does not include law enforcement officers, or
3 employees of municipal or county detention facilities or the
4 Department of Corrections, while acting in an official
5 capacity.
6 Section 4. Subsection (1) of section 827.01, Florida
7 Statutes, is amended to read:
8 827.01 Definitions.--As used in this chapter:
9 (1) "Caregiver" means a parent, adult household
10 member, law enforcement officer or employee of a municipal or
11 county detention facility or of the Department of Corrections
12 while acting in an official capacity, public school volunteer,
13 religious organization volunteer, health care provider, or
14 other person responsible for a child's welfare.
