7 | amending s. 1008.36, F.S.; providing for assignment of |
8 | school performance grades to certain feeder pattern |
9 | schools that do not receive such a grade for purposes of |
10 | participation in the program; defining feeder school |
11 | pattern; providing that a feeder pattern school shall be |
12 | subject to the Opportunity Scholarship Program; providing |
13 | an effective date. |

15 | Be It Enacted by the Legislature of the State of Florida: |

17 | Section 1. Subsection (3) of section 1008.36, Florida |
18 | Statutes, is amended to read: |
19 | 1008.36 Florida School Recognition Program.-- |
20 | (3) All public schools, including charter schools, that |
21 | receive a school grade pursuant to s. 1008.34 are eligible to |
22 | participate in the program. For the purpose of this section, a |
23 | school serving any combination of kindergarten through grade 3 |
24 | students that does not receive a school grade under s. 1008.34 |
25 | shall be assigned the school performance grade of the feeder |
26 | pattern school designated by the Department of Education and |
27 | verified by the school district and shall be eligible to |
28 | participate in the program based on that feeder. A feeder school |
29 | pattern is defined as a pattern where at least 60 percent of the |
30 | students in the school receiving the school grade came from the |
31 | same feeder school. In addition, the feeder pattern school shall |
32 | be subject to the Opportunity Scholarship Program as defined in |
33 | s. 1002.38. |

35 | Notwithstanding statutory provisions to the contrary, incentive |
36 | awards are not subject to collective bargaining. |
37 | Section 2. This act shall take effect July 1, 2005. |
