6An act relating to the Florida School Recognition Program;
7amending s. 1008.36, F.S.; providing for assignment of
8school performance grades to certain feeder pattern
9schools that do not receive such a grade for purposes of
10participation in the program; defining feeder school
11pattern; providing that a feeder pattern school shall be
12subject to the Opportunity Scholarship Program; providing
13an effective date.

15Be It Enacted by the Legislature of the State of Florida:
16
17     Section 1.  Subsection (3) of section 1008.36, Florida
18Statutes, is amended to read:
19     1008.36  Florida School Recognition Program.--
20     (3)  All public schools, including charter schools, that
21receive a school grade pursuant to s. 1008.34 are eligible to
22participate in the program. For the purpose of this section, a
23school serving any combination of kindergarten through grade 3
24students that does not receive a school grade under s. 1008.34
25shall be assigned the school performance grade of the feeder
26pattern school designated by the Department of Education and
27verified by the school district and shall be eligible to
28participate in the program based on that feeder. A feeder school
29pattern is defined as a pattern where at least 60 percent of the
30students in the school receiving the school grade came from the
31same feeder school. In addition, the feeder pattern school shall
32be subject to the Opportunity Scholarship Program as defined in
33s. 1002.38.

35Notwithstanding statutory provisions to the contrary, incentive
36awards are not subject to collective bargaining.
37     Section 2.  This act shall take effect July 1, 2005.
