12  Appropriations (Fasano) recommended the following amendment:

14         Senate Amendment (with title amendment) 
15         On page 29, between lines 15 and 16,
16  
17  insert:  
18         Section 3.  When the Public Service Commission
19  initiates an agency action affecting the substantial interest
20  of a utility regulated under chapter 367, Florida Statutes,
21  concerning any matter pertaining to section 120.60(5), Florida
22  Statutes, and a formal administrative hearing is requested
23  under section 120.57, Florida Statutes, the commission may
24  refer the matter to the Division of Administrative Hearings
25  for the assignment of an administrative law judge to conduct
26  the hearing and enter a recommended order.
