1 A bill to be entitled
2 An act relating to school capital outlay
3 funding; establishing the High Growth District
4 Capital Outlay Assistance Grant Program;
5 providing for use of funds to construct new
6 student stations; providing requirements for
7 school district qualification for a grant;
8 providing methodology for allocation of funds;
9 providing an effective date.

11 Be It Enacted by the Legislature of the State of Florida:

13 Section 1. (1) Subject to funds provided in the
14 General Appropriations Act, the High Growth District Capital
15 Outlay Assistance Grant Program is hereby established. Funds
16 provided pursuant to this section may only be used to
17 construct new student stations.
18 (2) In order to qualify for a grant, a school district
19 must meet the following criteria:
20 (a) The district must have levied the full 2 mills of
21 nonvoted discretionary capital outlay millage authorized in
22 section 1011.71(2), Florida Statutes, for each of the past 4
23 fiscal years.
24 (b) Fifty percent of the revenue derived from the
25 2-mill nonvoted discretionary capital outlay millage for the
26 past 4 fiscal years, when divided by the district's growth in
27 capital outlay FTE students over this period, produces a value
28 that is less than the average cost per student station
29 calculated pursuant to section 1013.72(2), Florida Statutes,
30 and weighted by statewide growth in capital outlay FTE

1 students in elementary, middle, and high schools for the past
2 4 fiscal years.
3 (c) The district must have equaled or exceeded twice
4 the statewide average of growth in capital outlay FTE students
5 over this same 4-year period.
6 (d) The Commissioner of Education must have released
7 all funds allocated to the district from the Classrooms for
8 Kids Program authorized in section 1013.68, Florida Statutes,
9 and these funds were fully expended by the district.
10 (e) The total capital outlay FTE students of the
11 district is greater than 15,000 students.
12 (3) The funds provided in the General Appropriations
13 Act shall be allocated pursuant to the following methodology:
14 (a) For each eligible district, the Department of
15 Education shall calculate the value of 50 percent of the
16 revenue derived from the 2-mill nonvoted discretionary capital
17 outlay millage for the past 4 fiscal years divided by the
18 increase in capital outlay FTE students for the same period.
19 (b) The Department of Education shall determine, for
20 each eligible district, the amount that must be added to the
21 value calculated pursuant to paragraph (a) to produce the
22 weighted average value per student station calculated pursuant
23 to paragraph (2)(b).
24 (c) The value calculated for each eligible district
25 pursuant to paragraph (b) shall be multiplied by the average
26 increase in capital outlay FTE students for the past 4 fiscal
27 years to determine the maximum amount of a grant that may be
28 awarded to a district pursuant to this section.
29 (d) In the event the funds provided in the General
30 Appropriations Act are insufficient to fully fund the maximum
31 grants calculated pursuant to paragraph (c), the Department of

1 Education shall allocate the funds based on each district's
2 prorated share of the total maximum award amount calculated
3 for all eligible districts.
4 Section 2. This act shall take effect July 1, 2005.
