A bill to be entitled
2An act relating to alcoholic beverage licenses; amending
3s. 565.02, F.S.; authorizing the issuance of a nonquota
4license to certain sporting and recreational lodges;
5requiring that sale or provision of alcoholic beverages by
6such entities conform to certain local ordinances;
7providing an effective date.

9Be It Enacted by the Legislature of the State of Florida:

11     Section 1.  Present subsection (12) of section 565.02,
12Florida Statutes, is renumbered as subsection (13), and a new
13subsection (12) is added to said section to read:
14     565.02  License fees; vendors; clubs; caterers; and
15others.--
16     (12)  A sporting and recreational lodge complex may obtain,
17upon the payment of appropriate fees, a license for on-premises
18consumption of alcoholic beverages not subject to any quota or
19limitation if the complex:
20     (a)  Comprises at least 10,000 acres of land.
21     (b)  Has indoor sleeping facilities with at least 12 rooms.
22     (c)  Has a restaurant that seats at least 25 persons.
23     (d)  Has been in continuous existence for at least 2 years.

25The enclosed area within the complex shall be considered the
26licensed premises upon the payment of the fee. Except as
27otherwise provided in this subsection, entities licensed under
28this subsection shall be treated as vendors licensed to sell
29alcoholic beverages by the drink and shall be subject to all the
30provisions relating to such vendors. However, notwithstanding
31any provision of law, such complex shall only sell or provide
32alcoholic beverages in a manner that is consistent with any
33local ordinance of a governing body having jurisdiction over the
34location of the complex.
35     Section 2.  This act shall take effect July 1, 2005.
