  1                      A bill to be entitled

  2         An act relating to trust funds; creating s.

  3         20.1971, F.S.; creating the Federal Grants

  4         Trust Fund within the Agency for Persons with

  5         Disabilities; providing sources of funds and

  6         purposes; providing for annual carryforward of

  7         funds; providing for future review and

  8         termination or re-creation of the trust fund;

  9         providing an effective date.

11  Be It Enacted by the Legislature of the State of Florida:

12  

13         Section 1.  Section 20.1971, Florida Statutes, is

14  created to read:

15         20.1971  Agency for Persons with Disabilities; trust

16  funds.--The following trust funds are created and shall be

17  administered by the Agency for Persons with Disabilities:

18         (5)  The Federal Grants Trust Fund.

19         (a)  Funds to be credited to the trust fund shall

20  consist of receipts from federal grants. Funds shall be used

21  for the purpose of providing health care services to agency

22  clients and for other such purposes as may be appropriate and

23  shall be expended only pursuant to legislative appropriation

24  or an approved amendment to the agency's operating budget

25  pursuant to the provisions of chapter 216.

26         (b)  Notwithstanding the provisions of s. 216.301 and

27  pursuant to s. 216.351, any balance in the trust fund at the

28  end of any fiscal year shall remain in the trust fund at the

29  end of the year and shall be available for carrying out the

30  purposes of the trust fund.

 1         (c)  In accordance with s. 19(f)(2), Art. III of the

 2  State Constitution, the Administrative Trust Fund shall,

 3  unless terminated earlier, be terminated on July 1, 2009.

 4  Before its scheduled termination, the trust fund shall be

 5  reviewed as provided in s. 215.3206(1) and (2).

 6         Section 2.  This act shall take effect on July 1, 2005.
