9 trust fund; providing an effective date.

11 Be It Enacted by the Legislature of the State of Florida:

13 Section 1. Section 20.1971, Florida Statutes, is
14 created to read:
15 20.1971 Agency for Persons with Disabilities; trust
16 funds.--The following trust funds are created and shall be
17 administered by the Agency for Persons with Disabilities:
18 (2) The Operations and Maintenance Trust Fund.
19 (a) Funds to be credited to the trust fund shall
20 consist of receipts from third-party payers of health care
21 services such as Medicaid. Funds shall be used for the purpose
22 of providing health care services to agency clients and for
23 other such purposes as may be appropriate and shall be
24 expended only pursuant to legislative appropriation or an
25 approved amendment to the agency's operating budget pursuant
26 to the provisions of chapter 216.
27 (b) Notwithstanding the provisions of s. 216.301 and
28 pursuant to s. 216.351, any balance in the trust fund at the
29 end of any fiscal year shall remain in the trust fund at the
30 end of the year and shall be available for carrying out the
31 purposes of the trust fund.

1 (c) In accordance with s. 19(f)(2), Art. III of the
2 State Constitution, the Operations and Maintenance Trust Fund
3 shall, unless terminated earlier, be terminated on July 1,
4 2009. Before its scheduled termination, the trust fund shall
5 be reviewed as provided in s. 215.3206(1) and (2).
6 Section 2. This act shall take effect on July 1, 2005.
