  1                      A bill to be entitled

  2         An act relating to trust funds; creating s.

  3         20.1971, F.S.; creating the Social Services

  4         Block Grant Trust Fund within the Agency for

  5         Persons with Disabilities; providing sources of

  6         funds and purposes; providing for annual

  7         carryforward of funds; providing for future

  8         review and termination or re-creation of the

  9         trust fund; providing an effective date.

11  Be It Enacted by the Legislature of the State of Florida:

12  

13         Section 1.  Section 20.1971, Florida Statutes, is

14  created to read:

15         20.1971  Agency for Persons with Disabilities; trust

16  funds.--The following trust funds are created and shall be

17  administered by the Agency for Persons with Disabilities:

18         (3)  The Social Services Block Grant Trust Fund.

19         (a)  Funds to be credited to the trust fund shall

20  consist of federal social services block grant funds. These

21  shall be used for the purpose of providing health care and

22  support services to agency clients and for other such purposes

23  as may be appropriate and shall be expended only pursuant to

24  legislative appropriation or an approved amendment to the

25  agency's operating budget pursuant to the provisions of

26  chapter 216.

27         (b)  Notwithstanding the provisions of s. 216.301 and

28  pursuant to s. 216.351, any balance in the trust fund at the

29  end of any fiscal year shall remain in the trust fund at the

30  end of the year and shall be available for carrying out the

31  purposes of the trust fund.

 1         (c)  In accordance with s. 19(f)(2), Art. III of the

 2  State Constitution, the Administrative Trust Fund shall,

 3  unless terminated earlier, be terminated on July 1, 2009.

 4  Before its scheduled termination, the trust fund shall be

 5  reviewed as provided in s. 215.3206(1) and (2).

 6         Section 2.  This act shall take effect on July 1, 2005.
