  1                      A bill to be entitled

  2         An act relating to trust funds; creating s.

  3         20.1971, F.S.; creating the Tobacco Settlement

  4         Trust Fund within the Agency for Persons with

  5         Disabilities; providing sources of funds and

  6         purposes; providing for the disposition of any

  7         unencumbered balance and any undisbursed

  8         encumbered balance at the end of any fiscal

  9         year; providing for future review and

10         termination or re-creation of the trust fund;

11         providing an effective date.

13  Be It Enacted by the Legislature of the State of Florida:

14  

15         Section 1.  Section 20.1971, Florida Statutes, is

16  created to read:

17         20.1971  Agency for Persons with Disabilities; trust

18  funds.--The following trust funds are created and shall be

19  administered by the Agency for Persons with Disabilities:

20         (4)  The Tobacco Settlement Trust Fund.

21         (a)  Funds to be credited to the trust fund shall

22  consist of funds disbursed, by nonoperating transfer, from the

23  Department of Financial Services Tobacco Settlement Clearing

24  Trust Fund in amounts equal to the annual appropriations made

25  from this trust fund.

26         (b)  Notwithstanding the provisions of s. 216.301 and

27  pursuant to s. 216.351, any unencumbered balance in the trust

28  fund at the end of any fiscal year and any encumbered balance

29  remaining undisbursed on December 31 of the same calendar year

30  shall revert to the Department of Financial Services Tobacco

31  Settlement Clearing Trust Fund.

 1         (c)  In accordance with s. 19(f)(2), Art. III of the

 2  State Constitution, the Tobacco Settlement Trust Fund shall,

 3  unless terminated earlier, be terminated on July 1, 2009.

 4  Before its scheduled termination, the trust fund shall be

 5  reviewed as provided in s. 215.3206(1) and (2).

 6         Section 2.  This act shall take effect on July 1, 2005.
