1 A bill to be entitled
2 An act relating to control of students;
3 repealing s. 1003.32(1)(k), F.S., relating to
4 discretionary corporal punishment by K-12
5 teachers; amending s. 1006.07, F.S.; requiring
6 each district school board to adopt a written
7 program of control or discipline with
8 alternative forms of control or discipline;
9 deleting provisions authorizing the district
10 school board to prohibit corporal punishment if
11 an alternate plan exists; providing an
12 effective date.

14 Be It Enacted by the Legislature of the State of Florida:
15
16 Section 1. Paragraph (k) of subsection (1) of section
17 1003.32, Florida Statutes, is repealed.
18 Section 2. Paragraph (a) of subsection (1) of section
19 1006.07, Florida Statutes, is amended to read:
20 1006.07 District school board duties relating to
21 student discipline and school safety.--The district school
22 board shall provide for the proper accounting for all
23 students, for the attendance and control of students at
24 school, and for proper attention to health, safety, and other
25 matters relating to the welfare of students, including:
26 (1) CONTROL OF STUDENTS.--
27 (a) Adopt rules for the control, discipline, in-school
28 suspension, suspension, and expulsion of students and decide
29 all cases recommended for expulsion. Suspension hearings are
30 exempted from the provisions of chapter 120. Expulsion
31 hearings shall be governed by ss. 120.569 and 120.57(2) and

1 are exempt from s. 286.011. However, the student's parent must
2 be given notice of the provisions of s. 286.011 and may elect
3 to have the hearing held in compliance with that section. The
4 district school board shall adopt a written program of control
5 or discipline which may include parent conferences, revocation
6 of privileges, work detail, community service, Saturday
7 school, and in-school restriction. The district school board
8 may prohibit the use of corporal punishment, if the district
9 school board adopts or has adopted a written program of
10 alternative control or discipline.
11 Section 3. This act shall take effect July 1, 2005.

14 SENATE SUMMARY
15 Removes corporal punishment as a means for discipline and
control of students. Requires district school boards to
16 adopt a plan for control which does not include corporal
punishment.
