11  The Committee on Criminal Justice (Smith) recommended the
12  following amendment:
13  
14         Senate Amendment (with title amendment) 
15         On page 2, between lines 8 and 9,
16  
17  insert:  
18         (5)  It is a misdemeanor of the first degree,
19  punishable as in provided in s. 775.082 or s. 775.083, to
20  intentionally or willfully:
21         a.  Tamper with or otherwise render an automated
22  external defibrillator inoperative except during such time as
23  the automated external defibrillator is being serviced,
24  tested, repaired, or recharged, except pursuant to court
25  order.
26         b.  Obliterate the serial number on an automated
27  external defibrillator for purposes of falsifying service
28  records.
29         c.  Improperly service, recharge, repair, test, or
30  inspect an automated external defibrillator, if so provided by
31  a municipal or county code.

 1         d.  Use the license, permit, or inspection certificate
 2  of another person, if so provided by a municipal or county
 3  code.
 4         e.  Hold a permit or inspection certificate and allow
 5  another person to use that permit or inspection certificate
 6  number, if so provided by a municipal or county code.
 7         f.  Use, or permit the use of, any license, permit, or
 8  inspection certificate by any individual or organization other
 9  than the one to whom the license, permit, or inspection
10  certificate is issued, if so provided by a municipal or county
11  code.

16         On page 1, line 8, after the semicolon,

18  insert:
19         providing that it is a first-degree misdemeanor
20         to tamper with, obliterate the serial number

23         inspection certificate without authorization;
