3 defibrillators; amending s. 401.2915, F.S.;
4 authorizing state and local law enforcement
5 vehicles to carry an automated external
6 defibrillator; amending s. 932.7055, F.S.;
7 authorizing local governments to use forfeiture
8 funds for purchasing automated external
9 defibrillators; providing an effective date.

11 Be It Enacted by the Legislature of the State of Florida:
12
13 Section 1. Section 401.2915, Florida Statutes, is
14 amended to read:
15 401.2915 Automated external defibrillators.--It is the
16 intent of the Legislature that an automated external
17 defibrillator may be used by any person for the purpose of
18 saving the life of another person in cardiac arrest. In order
19 to ensure public health and safety:
20 (1) All persons who use an automated external
21 defibrillator must obtain appropriate training, to include
22 completion of a course in cardiopulmonary resuscitation or
23 successful completion of a basic first aid course that
24 includes cardiopulmonary resuscitation training, and
25 demonstrated proficiency in the use of an automated external
26 defibrillator.;
27 (2) Any person or entity in possession of an automated
28 external defibrillator is encouraged to register with the
29 local emergency medical services medical director the
30 existence and location of the automated external
31 defibrillator.; and

1 (3) Any person who uses an automated external
2 defibrillator shall is required to activate the emergency
3 medical services system as soon as possible upon use of the
4 automated external defibrillator.
5 (4) Each local and state law enforcement vehicle may
6 carry an automated external defibrillator.
7 Section 2. Paragraph (a) of subsection (5) of section
8 932.7055, Florida Statutes, is amended to read:
9 932.7055 Disposition of liens and forfeited
10 property.--
11 (5)(a) If the seizing agency is a county or municipal
12 agency, the remaining proceeds shall be deposited in a special
13 law enforcement trust fund established by the board of county
14 commissioners or the governing body of the municipality. Such
15 proceeds and interest earned therefrom shall be used for
16 school resource officer, crime prevention, safe neighborhood,
17 drug abuse education and prevention programs, or for other law
18 enforcement purposes, which include defraying the cost of
19 protracted or complex investigations, providing additional
20 equipment or expertise, purchasing automated external
21 defibrillators for use in law enforcement vehicles, and
22 providing matching funds to obtain federal grants. The
23 proceeds and interest may not be used to meet normal operating
24 expenses of the law enforcement agency.
25 Section 3. This act shall take effect July 1, 2005.
