7South Florida Water Management District; creating s.
8373.1135, F.S.; authorizing water management districts to
9implement a small business program; providing rulemaking
10authority; providing an effective date.

12Be It Enacted by the Legislature of the State of Florida:
13
14     Section 1.  Paragraphs (l) and (m) are added to subsection
15(1) of section 373.1501, Florida Statutes, and subsection (3) of
16said section is amended, to read:
17     373.1501  South Florida Water Management District as local
18sponsor.--
19     (1)  As used in this section and s. 373.026(8), the term:
20     (l)  "Biscayne Bay Coastal Wetlands-Phase 1 Project - C-1
21Cutler Wetlands Component" means the C-1 Cutler Wetlands
22Components in the Biscayne Bay Coastal Wetlands-Phase 1 Acceler8
23Project approved by the South Florida Water Management District
24(SFWMD) Governing Board on November 9, 2004. A map showing the
25C-1 Cutler Wetlands Component area is on file with the Clerk of
26the SFWMD.
27     (m)  "C-111 Spreader Canal Project" means the C-111
28Spreader Canal Project described in the Final Integrated
29Feasibility Report and Programmatic Environmental Impact
30Statement for the Central and Southern Florida Project
31Comprehensive Review Study, dated April 1999 and authorized by
32Congress through the Water Resources Development Act of 2000,
33Section 601(b)(2)(C)(x).
34     (3)  The Legislature declares that the Kissimmee River
35Restoration Project, the Ten Mile Creek Project, the Water
36Preserve Areas, the Southern Corkscrew Regional Ecosystem
37Watershed Project, the Pal-Mar Project, and the C-111 Project,
38the C-111 Spreader Canal Project, and the Biscayne Bay Coastal
39Wetlands-Phase 1 Project - C-1 Cutler Wetlands Component are in
40the public interest, for a public purpose, and necessary for the
41public health and welfare. The governing board of the district
42is empowered and authorized to acquire fee title or easement by
43eminent domain for the limited purposes of implementing the
44Kissimmee River Restoration Project, the Ten Mile Creek Project,
45the Water Preserve Areas, the Southern Corkscrew Regional
46Ecosystem Watershed Project, the Pal-Mar Project, and the C-111
47Project, the C-111 Spreader Canal Project, and the Biscayne Bay
48Coastal Wetlands-Phase 1 Project - C-1 Cutler Wetlands
49Component. Any acquisition of real property, including by
50eminent domain, for those objectives constitutes a public
51purpose for which it is in the public interest to expend public
52funds. Notwithstanding any provision of law to the contrary,
53such properties shall not be removed from the district's plan of
54acquisition, and the use of state funds for these properties is
55authorized. In the absence of willing sellers, any land
56necessary for implementing the projects in this subsection shall
57be acquired in accordance with state condemnation law pursuant
58to chapters 73 and 74.
59     Section 2.  Section 373.1135,Florida Statutes, is created
60to read:
61     373.11135  Small business program.-Each water management
62district, as created in this chapter, may implement a small
63business program designed to help small businesses, including
64those owned by women and minorities, participate in district
65procurement and contract activities. The purpose of the program
66is to spur economic development and support small businesses,
67including women and minority-owned businesses, to successfully
68expand in the marketplace. Program specifics shall be provided
69by rule pursuant to s. 373.113.
70     Section 3.  This act shall take effect upon becoming a law.
