3	373.1501, F.S.; providing definitions; including the C-111
4	Spreader Canal Project and the Biscayne Bay Coastal
5	Wetlands-Phase 1 Project - C-1 Cutler Wetlands Component
6	among certain local sponsorship responsibilities of the
7	South Florida Water Management District; creating s.
8	373.1135, F.S.; authorizing water management districts to
9	implement a small business program; providing rulemaking
10	authority; providing an effective date.

12	Be It Enacted by the Legislature of the State of Florida:
13
14	Section 1.  Paragraphs (l) and (m) are added to subsection
15	(1) of section 373.1501, Florida Statutes, and subsection (3) of
16	said section is amended, to read:
17	373.1501  South Florida Water Management District as local
18	sponsor.--
19	(1)  As used in this section and s. 373.026(8), the term:
20	(l)  "Biscayne Bay Coastal Wetlands-Phase 1 Project - C-1
21	Cutler Wetlands Component" means the C-1 Cutler Wetlands
22	Components in the Biscayne Bay Coastal Wetlands-Phase 1 Acceler8
23	Project approved by the South Florida Water Management District
24	(SFWMD) Governing Board on November 9, 2004. A map showing the
25	C-1 Cutler Wetlands Component area is on file with the Clerk of
26	the SFWMD.
27	(m)  "C-111 Spreader Canal Project" means the C-111
28	Spreader Canal Project described in the Final Integrated
29	Feasibility Report and Programmatic Environmental Impact
30	Statement for the Central and Southern Florida Project
31	Comprehensive Review Study, dated April 1999 and authorized by
32	Congress through the Water Resources Development Act of 2000,
33	Section 601(b)(2)(C)(x).
34	(3)  The Legislature declares that the Kissimmee River
35	Restoration Project, the Ten Mile Creek Project, the Water
36	Preserve Areas, the Southern Corkscrew Regional Ecosystem
37	Watershed Project, the Pal-Mar Project, and the C-111 Project,
38	the C-111 Spreader Canal Project, and the Biscayne Bay Coastal
39	Wetlands-Phase 1 Project - C-1 Cutler Wetlands Component are in
40	the public interest, for a public purpose, and necessary for the
41	public health and welfare. The governing board of the district
42	is empowered and authorized to acquire fee title or easement by
43	eminent domain for the limited purposes of implementing the
44	Kissimmee River Restoration Project, the Ten Mile Creek Project,
45	the Water Preserve Areas, the Southern Corkscrew Regional
46	Ecosystem Watershed Project, the Pal-Mar Project, and the C-111
47	Project, the C-111 Spreader Canal Project, and the Biscayne Bay
48	Coastal Wetlands-Phase 1 Project - C-1 Cutler Wetlands
49	Component. Any acquisition of real property, including by
50	eminent domain, for those objectives constitutes a public
51	purpose for which it is in the public interest to expend public
52	funds. Notwithstanding any provision of law to the contrary,
53	such properties shall not be removed from the district's plan of
54	acquisition, and the use of state funds for these properties is
55	authorized. In the absence of willing sellers, any land
56	necessary for implementing the projects in this subsection shall
57	be acquired in accordance with state condemnation law pursuant
58	to chapters 73 and 74.
59	Section 2.  Section 373.1135,Florida Statutes, is created
60	to read:
61	373.11135  Small business program.-Each water management
62	district, as created in this chapter, may implement a small
63	business program designed to help small businesses, including
64	those owned by women and minorities, participate in district
65	procurement and contract activities. The purpose of the program
66	is to spur economic development and support small businesses,
67	including women and minority-owned businesses, to successfully
68	expand in the marketplace. Program specifics shall be provided
69	by rule pursuant to s. 373.113.
70	Section 3.  This act shall take effect upon becoming a law.
