  1                      A bill to be entitled

  2         An act relating to the education of children of

  3         deceased or disabled veterans; amending s.

  4         295.01, F.S.; extending the opportunity to

  5         receive postsecondary educational benefits at

  6         state expense to the dependent children of

  7         certain dead or disabled veterans who were

  8         Florida residents when the death or disability

  9         occurred; decreasing the minimum required

10         length of the parent's residency; providing an

11         effective date.

13  Be It Enacted by the Legislature of the State of Florida:

14  

15         Section 1.  Section 295.01, Florida Statutes, is

16  amended to read:

17         295.01  Children of deceased or disabled veterans;

18  education.--

19         (1)  It is hereby declared to be the policy of the

20  state to provide educational opportunity at state expense for

21  dependent children either of whose parents:

22         (a)  Was a resident of the state at the time such

23  parent entered the Armed Forces and:

24         1.(a)  Died as a result of service-connected injuries,

25  disease, or disability sustained while on active duty; or

26         2.(b)  Has been:

27         a.1.  Determined by the United States Department of

28  Veterans Affairs or its predecessor to have a

29  service-connected 100-percent total and permanent disability

30  rating for compensation;

 1         b.2.  Determined to have a service-connected total and

 2  permanent disability rating of 100 percent and is in receipt

 3  of disability retirement pay from any branch of the United

 4  States Armed Services; or

 5         c.3.  Issued a valid identification card by the

 6  Department of Veterans' Affairs in accordance with s. 295.17;

 7         (b)  Met all Florida residency requirements at the time

 8  of death or the occurrence of the disability, as described in

 9  paragraph (a),

11  when the deceased or disabled parent of such a child has been

12  a bona fide resident parents of such children have been bona

13  fide residents of the state for at least 1 year immediately 5

14  years next preceding the death or occurrence of such

15  disability their application for the benefits hereof, and

16  subject to the rules, restrictions, and limitations set forth

17  in this section hereof.

18         (2)  Sections The provisions of ss. 295.03, 295.04,

19  295.05, and 1009.40 shall apply to the benefits provided under

20  this section.

21         (3)  The State Board of Education shall adopt rules for

22  administering this section.

23         Section 2.  This act shall take effect July 1, 2005.

26                          SENATE SUMMARY

27    Extends the opportunity to receive postsecondary
      educational benefits at state expense to the dependent
28    children of certain deceased or disabled veterans who
      were Florida residents when the death or disability
29    occurred. (Current law provides such benefits only if the
      parent was a resident of this state when he or she
30    entered the Armed Forces.) Decreases from 5 years to 1
      year the minimum required length of the parent's
31    residency.
