  1                      A bill to be entitled

  2         An act relating to renewable energy; amending

  3         s. 366.075, F.S.; authorizing the Public

  4         Service Commission to approve experimental or

  5         transitional rates to encourage the use of

  6         renewable energy; providing an effective date.

  8  Be It Enacted by the Legislature of the State of Florida:

  9  

10         Section 1.  Section 366.075, Florida Statutes, is

11  amended to read:

12         366.075  Experimental and transitional rates.--

13         (1)  The commission is authorized to approve rates on

14  an experimental or transitional basis for any public utility

15  to encourage energy conservation or to encourage efficiency.

16  The application of such rates may be for limited geographic

17  areas and for a limited period.

18         (2)  The commission may approve rates on an

19  experimental or transitional basis for any public utility to

20  encourage the use of energy from a renewable energy resource,

21  as that term is defined in s. 377.703(2). The experimental

22  rates may not result in an increase exceeding one-fourth of 1

23  percent of base rates. The application of such rates may be

24  for limited geographic areas and for a limited period.

25         (3)(2)  The commission is authorized to approve the

26  geographic area used in testing experimental rates and shall

27  specify in the order setting those rates the area affected.

28  The commission may extend the period designated for the test

29  if it determines that further testing is necessary to fully

30  evaluate the effectiveness of such experimental rates.

31         Section 2.  This act shall take effect October 1, 2005.
