  1                      A bill to be entitled

  2         An act relating to renewable energy; amending

  3         s. 366.075, F.S.; authorizing the Public

  4         Service Commission to approve experimental or

  5         transitional rates to encourage the use of

  6         renewable energy; providing an effective date.

  8  Be It Enacted by the Legislature of the State of Florida:

  9  

10         Section 1.  Section 366.075, Florida Statutes, is

11  amended to read:

12         366.075  Experimental and transitional rates.--

13         (1)  The commission is authorized to approve rates on

14  an experimental or transitional basis for any public utility

15  to encourage energy conservation, or to encourage efficiency,

16  or use of energy from a renewable energy resource, as that

17  term is defined in s. 377.703(2). The application of such

18  rates may be for limited geographic areas and for a limited

19  period.

20         (2)  The commission is authorized to approve the

21  geographic area used in testing experimental rates and shall

22  specify in the order setting those rates the area affected.

23  The commission may extend the period designated for the test

24  if it determines that further testing is necessary to fully

25  evaluate the effectiveness of such experimental rates.

26         Section 2.  This act shall take effect October 1, 2005.
