  1                      A bill to be entitled

  2         An act relating to vehicle crashes; creating

  3         the "Justin McWilliams 'Justice For Justin'

  4         Act"; amending s. 316.027, F.S.; revising

  5         provisions for a driver of a vehicle involved

  6         in a described crash to stop and remain at the

  7         scene of the crash; providing penalties;

  8         providing an effective date.

10  Be It Enacted by the Legislature of the State of Florida:

11  

12         Section 1.  This act may be cited as the "Justin

13  McWilliams 'Justice For Justin' Act."

14         Section 2.  Subsection (1) of section 316.027, Florida

15  Statutes, is amended to read:

16         316.027  Crash involving death or personal injuries.--

17         (1)(a)  The driver of any vehicle involved in a crash

18  occurring on public or private property that results resulting

19  in injury of any person must immediately stop the vehicle at

20  the scene of the crash, or as close thereto as possible, and

21  must remain at the scene of the crash until he or she has

22  fulfilled the requirements of s. 316.062. Any person who

23  willfully violates this paragraph is guilty of a felony of the

24  third degree, punishable as provided in s. 775.082, s.

25  775.083, or s. 775.084.

26         (b)  The driver of any vehicle involved in a crash

27  occurring on public or private property that results resulting

28  in the death of any person must immediately stop the vehicle

29  at the scene of the crash, or as close thereto as possible,

30  and must remain at the scene of the crash until he or she has

31  fulfilled the requirements of s. 316.062. Any person who

 1  willfully violates this paragraph is guilty of a felony of the

 2  second degree, punishable as provided in s. 775.082, s.

 3  775.083, or s. 775.084.

 4         Section 3.  This act shall take effect upon becoming a

 5  law.
