11  The Committee on Banking and Insurance (Campbell) recommended
12  the following amendment:

14         Senate Amendment 
15         On page 56, lines 1-7, delete those lines
16  
17  and insert:  
18         (b)  However, if the amount of loss caused by the
19  covered peril to the property is such that, but for the loss
20  caused by the covered peril, the property would not be a total
21  loss, it is the intent of the Legislature that the insurer is
22  responsible for the total amount of its policy limits. For
23  purposes of covered losses, any code upgrade required by any
24  governmental body shall be construed to be a covered peril.
