1 A bill to be entitled
2 An act relating to eligibility for Medicaid
3 payments; amending s. 409.903, F.S.; increasing
4 the income level at which a pregnant woman is
5 eligible to receive Medicaid services;
6 providing an effective date.

8 Be It Enacted by the Legislature of the State of Florida:

10 Section 1. Subsection (5) of section 409.903, Florida
11 Statutes, is amended to read:
12 409.903 Mandatory payments for eligible persons.--The
13 agency shall make payments for medical assistance and related
14 services on behalf of the following persons who the
15 department, or the Social Security Administration by contract
16 with the Department of Children and Family Services,
17 determines to be eligible, subject to the income, assets, and
18 categorical eligibility tests set forth in federal and state
19 law. Payment on behalf of these Medicaid eligible persons is
20 subject to the availability of moneys and any limitations
21 established by the General Appropriations Act or chapter 216.
22 (5) A pregnant woman for the duration of her pregnancy
23 and for the postpartum period as defined in federal law and
24 rule, or a child under age 1, if either is living in a family
25 that has an income which is at or below 150 percent of the
26 most current federal poverty level, or, effective January 1,
27 1992, that has an income which is at or below 185 percent of
28 the most current federal poverty level. Such a person is not
29 subject to an assets test. Further, a pregnant woman who
30 applies for eligibility for the Medicaid program through a
31 qualified Medicaid provider must be offered the opportunity,

1 subject to federal rules, to be made presumptively eligible
2 for the Medicaid program. Effective July 1, 2005, eligibility
3 for Medicaid services is eliminated for women who have incomes
4 above 185 150 percent of the most current federal poverty
5 level.
6 Section 2. This act shall take effect upon becoming a
7 law.

12 pregnant woman is eligible for Medicaid services.
