1 A bill to be entitled
2 An act relating to health care disclosure;
3 providing definitions; requiring the Office of
4 Insurance Regulation of the Department of
5 Financial Services to identify employers of
6 persons receiving certain medical assistance
7 and employers of proposed beneficiaries of
8 certain health care benefits; requiring reports
9 to the Legislature; providing for public access
10 to such information; providing an effective
11 date.

13 Be It Enacted by the Legislature of the State of Florida:
14
15 Section 1. Medical assistance.--
16 (1) For purposes of this section:
17 (a) "Small employer" means any person, firm,
18 corporation, partnership, association, political subdivision,
19 or self-employed individual that is actively engaged in
20 business that, during the preceding calendar quarter, employed
21 no more than 50 employees who worked an average of 30 or more
22 hours per week.
23 (b) "Large employer" means any person, firm,
24 corporation, partnership, association, political subdivision,
25 or self-employed individual that is actively engaged in
26 business that, during the preceding calendar quarter, employed
27 more than 50 employees who worked an average of 30 or more
28 hours per week.
29 (2) On or before February 1 of each year, the Office
30 of Insurance Regulation of the Department of Financial
31 Services shall provide to the appropriate committees of the

1 Senate and House of Representatives a report that identifies
2 employers whose employees are receiving benefits through
3 medical assistance for themselves or their dependents. The
4 report must include whether the employer is a large employer
5 or a small employer, and for each employer:
6 (a) The name and address of the employer.
7 (b) The number of employees who are receiving benefits
8 through medical assistance.
9 (c) The number of enrollees who are spouses or
10 dependents of their employees.
11 (d) Whether the employer offers health benefits to his
12 or her employees.
13 (e) The cost to the state of providing medical
14 assistance for their employees and enrolled dependents.
15 Section 2. Health care benefits.--
16 (1) Any applicant for health care benefits under
17 public assistance programs, including, but not limited to,
18 Medicaid or the Children's Medical Services Network, shall
19 identify the employer or employers of the proposed beneficiary
20 of the health care benefits. In the event the proposed
21 beneficiary is not employed, the applicant shall identify the
22 employer or employers of any adult who is responsible for
23 providing all or some of the proposed beneficiary's support.
24 As used in this section, the term "proposed beneficiary" means
25 any individual who files an application for benefits for
26 himself or herself or any other individual on whose behalf an
27 application is filed, including, but not limited to, children
28 or other dependents of the applicant or other individual for
29 whom the application is filed.
30 (2) On or before July 1 of each year, the Office of
31 Insurance Regulation of the Department of Financial Services

1 shall provide to the appropriate committees of the Senate and
2 House of Representatives a report that identifies employers of
3 a proposed beneficiary, or of the adult responsible for a
4 proposed beneficiary's support, of applicants for health care
5 benefits pursuant to the requirements in subsection (1). The
6 report shall include the name and address of the employer and
7 the total number of employees and dependants who are enrolled
8 in each state-funded health care program. No other information
9 regarding program beneficiaries shall be included in the
10 report. In addition to filing the report with the appropriate
11 committees of the Senate and the House of Representatives, the
12 office shall make the report available to the public through
13 the office's Internet website. Any member of the public shall
14 have the right to request and receive a copy of the report
15 published pursuant to this subsection.
16 Section 3. This act shall take effect July 1, 2005.
