  1                      A bill to be entitled

  2         An act relating to phosphate mining; amending

  3         s. 215.20, F.S.; eliminating the Phosphate

  4         Research Trust Fund from among the enumerated

  5         trust funds that contribute to the General

  6         Revenue Fund; amending s. 215.22, F.S.;

  7         exempting the Phosphate Research Trust Fund

  8         from the contribution to the General Revenue

  9         Fund required under s. 215.20, F.S.; repealing

10         s. 378.101(1)(i), F.S., relating to a

11         requirement that subjects the Phosphate

12         Research Trust Fund to the service charge

13         imposed under ch. 215, F.S.; providing an

14         effective date.

16  Be It Enacted by the Legislature of the State of Florida:

17  

18         Section 1.  Paragraph (h) of subsection (4) of section

19  215.20, Florida Statutes, is amended to read:

20         215.20  Certain income and certain trust funds to

21  contribute to the General Revenue Fund.--

22         (4)  The income of a revenue nature deposited in the

23  following described trust funds, by whatever name designated,

24  is that from which the appropriations authorized by subsection

25  (3) shall be made:

26         (h)  Within the Department of Education,:

27         1.  the Educational Certification and Service Trust

28  Fund.

29         2.  The Phosphate Research Trust Fund.

 1  The enumeration of the foregoing moneys or trust funds shall

 2  not prohibit the applicability thereto of s. 215.24 should the

 3  Governor determine that for the reasons mentioned in s. 215.24

 4  the money or trust funds should be exempt herefrom, as it is

 5  the purpose of this law to exempt income from its force and

 6  effect when, by the operation of this law, federal matching

 7  funds or contributions or private grants to any trust fund

 8  would be lost to the state.

 9         Section 2.  Paragraph (k) of subsection (1) and

10  subsection (4) of section 215.22, Florida Statutes, are

11  amended to read:

12         215.22  Certain income and certain trust funds

13  exempt.--

14         (1)  The following income of a revenue nature or the

15  following trust funds shall be exempt from the appropriation

16  required by s. 215.20(1):

17         (k)  Trust funds administered by the Department of

18  Education, including the Phosphate Research Trust Fund.

19         (4)  Notwithstanding the exemptions granted in

20  subsections (1), (2), and (3), this section shall not exempt

21  income of a revenue nature or any trust fund which was subject

22  to the service charge pursuant to s. 215.20 on January 1,

23  1990. This subsection does not apply to the Phosphate Research

24  Trust Fund.

25         Section 3.  Paragraph (i) of subsection (1) of section

26  378.101, Florida Statutes, is repealed.

27         Section 4.  This act shall take effect July 1, 2005.
