7An act relating to Medicaid; amending s. 409.906, F.S.;
8authorizing the Agency for Health Care Administration to
9pay for certain visual services prescribed to Medicaid
10recipients regardless of age; providing an appropriation;
11providing an effective date.

13Be It Enacted by the Legislature of the State of Florida:
14
15     Section 1.  Subsection (23) of section 409.906, Florida
16Statutes, is amended to read:
17     409.906  Optional Medicaid services.--Subject to specific
18appropriations, the agency may make payments for services which
19are optional to the state under Title XIX of the Social Security
20Act and are furnished by Medicaid providers to recipients who
21are determined to be eligible on the dates on which the services
22were provided. Any optional service that is provided shall be
23provided only when medically necessary and in accordance with
24state and federal law. Optional services rendered by providers
25in mobile units to Medicaid recipients may be restricted or
26prohibited by the agency. Nothing in this section shall be
27construed to prevent or limit the agency from adjusting fees,
28reimbursement rates, lengths of stay, number of visits, or
29number of services, or making any other adjustments necessary to
30comply with the availability of moneys and any limitations or
31directions provided for in the General Appropriations Act or
32chapter 216. If necessary to safeguard the state's systems of
33providing services to elderly and disabled persons and subject
34to the notice and review provisions of s. 216.177, the Governor
35may direct the Agency for Health Care Administration to amend
36the Medicaid state plan to delete the optional Medicaid service
37known as "Intermediate Care Facilities for the Developmentally
38Disabled." Optional services may include:
39     (23)  CHILDREN'S VISUAL SERVICES.--The agency may pay for
40visual examinations, eyeglasses, and eyeglass repairs for a
41recipient younger than 21 years of age, if they are prescribed
42by a licensed physician specializing in diseases of the eye or
43by a licensed optometrist.
44     Section 2.  There are hereby appropriated the sums of
45$2,399,934 from the General Revenue Fund, $3,437,897 from the
46Medical Care Trust Fund, and $190,394 from the Refugee
47Assistance Trust Fund to the Agency for Health Care
48Administration for the 2005-2006 fiscal year to provide adult
49vision services to Medicaid recipients.
50     Section 3.  This act shall take effect July 1, 2005.
