2An act relating to the Hastings Drainage District, Putnam
3and St. Johns Counties; codifying, amending, reenacting,
4and repealing chapters 7969 (1919), 8880 (1921), 10671
5(1925), 13654 (1929), 15616 (1931), 17978 (1937), 27310
6(1951), 28382 (1953), 81-481, 88-511, and 89-514, Laws of
7Florida, relating to the district; providing for the
8continuation without interruption of the district and its
9boundaries as previously created and established;
10providing for membership of the Hastings Drainage District
11Board; providing for the powers, functions, and duties of
12the district; providing an effective date.

14Be It Enacted by the Legislature of the State of Florida:
15
16     Section 1.  Pursuant to section 189.429, Florida Statutes,
17this act constitutes the codification of all special acts
18relating to the Hastings Drainage District, Putnam and St. Johns
19Counties. It is the intent of the Legislature in enacting this
20law to provide a single, comprehensive special act charter for
21the district, including all current legislative authority
22granted to the district by its several legislative enactments
23and any additional authority granted by this act. It is further
24the intent of this act to preserve all district authority.
25     Section 2.  Chapters 7969 (1919), 8880 (1921), 10671
26(1925), 13654 (1929), 15616 (1931), 17978 (1937), 27310 (1951),
2728382 (1953), 81-481, 88-511, and 89-514, Laws of Florida, are
28codified, reenacted, amended, and repealed as herein provided.
29     Section 3.  The charter for the Hastings Drainage District
30 is reenacted and re-created to read:
31     Section 1.  The district is created for the purpose of
32draining, reclaiming, and maintaining the lands hereinafter
33described, and protecting the same from the effects of waters
34for agricultural and sanitary purposes, and for the public
35convenience, utility, welfare, and benefit.
36     Section 2.  The district retains all rights with respect to
37rights-of-way in the following area and retains the right for
38the normal flow of water through the area described below for
39the protection of the district. Sixteen Mile Creek Water Control
40District shall maintain all said rights-of-way in the following
41area as a part of its water management plan at no charge to the
42district or its landowners. The area is described as follows:

553     Section 4.  The governing board of the district shall be
554the Board of Supervisors of Hastings Drainage District and shall
555be composed of three persons, all of whom shall be citizens of
556the United States, residents of either St. Johns County or
557Putnam County, and owners of land or stockholders in
558corporations owning land lying within the boundaries of the
559district. The present board of supervisors ("board") and the
560terms of office for its members are as follows: Frank C. Johns,
561Jr., whose term of office expires November 30, 2006; W. W.
562Tilton, Jr., whose term of office expires November 30, 2007; and
563Daniel S. Johns, whose term of office expires November 30, 2005.
564On the third Tuesday in October of each year, the district shall
565call a meeting of the landowners in the district to elect one
566supervisor as successor to the supervisor whose term of office
567will expire the following December, the term of such supervisor
568so elected to begin on the first day of December next following
569his or her election, and that supervisor shall hold office for 3
570years. The election shall be conducted in accordance with the
571provisions of section 298.11, Florida Statutes.
572     Section 5.  Immediately after the election or appointment
573of its members, the board shall meet and elect from among its
574members a president. The board shall also elect as secretary
575some suitable person, who may or may not be a member of the
576board.
577     Section 6.  The board shall cause to be kept a well-bound
578book, entitled "Record of Board of Supervisors of the Hastings
579Drainage District," in which shall be recorded minutes of all
580meetings, proceedings, certificates, bonds given by all
581employees, and all corporate acts, which record shall at all
582reasonable times be open to the inspection of anyone interested.
583     Section 7.  The board shall have all the powers of a body
584corporate, including the powers to sue and be sued by its name
585in any court of law or equity; to make contracts; to adopt and
586use a common seal and to alter the same at pleasure; to hold,
587buy, and convey such personal and real property that may be
588necessary for the purposes of the district; and to appoint
589agents and employees as the business of the district may
590require.
591     Section 8.  The board shall report to the landowners, at
592the annual meeting held under the provisions of section 298.12,
593Florida Statutes, any work that has been done, either by
594engineers or otherwise.
595     Section 9.  Board members shall be reimbursed for their
596travel expenses pursuant to section 112.061, Florida Statutes,
597but shall receive no compensation for their service unless the
598landowners at the annual meeting determine to pay a
599compensation, which in no event may exceed $50 per day for the
600time actually engaged in work for the district and in attending
601sessions of the board.
602     Section 10.  The board shall appoint a district engineer
603and pay him or her such reasonable salary as may be determined
604necessary and proper, or may contract for engineering work. The
605engineer shall make a report in writing to the board once every
60612 months or as directed by the board. The report shall describe
607the progress made and activities undertaken in furtherance of
608the water control plan, and may include suggestions and
609recommendations to the board as the engineer deems appropriate.
610     Section 11.  The board shall select and appoint some
611competent person, bank, or trust company, organized under the
612laws of the state, as treasurer of the district, who shall
613receive and receipt for all the drainage taxes collected by the
614county collector or collectors, and the treasurer shall receive
615and receipt for the proceeds of all tax sales made under the
616provisions of this chapter. The board shall audit or have
617audited the books of the district's treasurer at least once
618every year and make a report thereof to the landowners at the
619annual meeting and publish a statement within 30 days
620thereafter, showing the amount of money received, the amount
621paid out during such year, and the amount in the treasury at the
622beginning and end of the year. A certified copy of the annual
623audit shall be filed with the state auditor.
624     Section 12.  The board shall employ an attorney to act for
625the district and to advise the board. Such employment shall be
626evidenced by an agreement in writing which, as far as possible,
627shall specify the exact amount to be paid to the attorney for
628all services and expenses.
629     Section 13.  The board has full power and authority to
630construct, complete, operate, maintain, repair, and replace any
631and all works and improvements necessary to execute the
632district's water control plan, including all of the powers
633conferred on the district by sections 298.22 and 298.23, Florida
634Statutes.
635     Section 14.  For the purposes of this act, and particularly
636for the purpose of levying and imposing taxes and assessments
637hereinafter levied and imposed, or authorized to be levied and
638imposed, the territory lying and being within the Hastings
639Drainage District is hereby divided and constituted into zones
640as referenced in section 3.
641     Section 15.  (1)  The taxes and assessments in this act
642levied and authorized to be levied shall be used exclusively for
643the several purposes, uses, and objects specified in this act.
644An annual tax not to exceed $20 per acre per year is authorized
645to be levied by the board. Said tax may vary from zone to zone
646but shall be uniform within a zone.
647     (2)  Any parcel of land less than 1 acre in area shall bear
648only its proportionate part of the tax authorized by this act to
649be levied.
650     (3)  For the purpose of enabling the board to carry out the
651purposes of this act, the Legislature hereby finds such tax is a
652reasonable tax on all such lands, and that said lands are and
653will be benefited in excess of the amount of the tax hereby
654levied.
655     Section 16.  The board shall annually prepare a list of all
656the lands included in the district, showing the zone and tax,
657and shall transmit such list to the Tax Assessor of Putnam
658County and to the Tax Assessor of St. Johns County, who shall
659enter annually upon the county tax rolls the aforesaid levy,
660including the tax for the district in his or her warrant as
661prescribed by law, and such drainage tax shall be collected by
662the Tax Collector of Putnam County and the Tax Collector of St.
663Johns County at the same time and as other county taxes on real
664estate are collected, and such tax collectors shall deposit the
665same to the credit of the board created by this act, furnishing
666said board with a statement of the amount thereof. Said money
667shall be used only for the purposes provided herein, after
668paying the cost of assessing said lands, which is hereby
669estimated at 2 percent, and the tax collectors' fees, as fixed
670by law.
671     Section 17.  (1)  On the nonpayment of drainage taxes on
672any parcel of land lying within said district, the drainage tax
673shall be treated in the same manner as any other unpaid county
674taxes and shall be included in the tax certificates issued
675thereon; and on redemption or purchase of a certificate which
676includes an item of the district taxes, the tax collector or
677clerk shall pay over to the board the amount of such drainage
678taxes and interest included in said certificate.
679     (2)  Where title to any lands lying in the district is
680vested in Putnam County or St. Johns County and sold, the clerk
681of the circuit court in the county wherein any such parcel is
682situate shall disburse to the district the percentage of the net
683sum received from the sale of the land in the same proportion as
684the amount of drainage tax bore to the total tax on said parcel
685outstanding at the time of sale. The lands when sold by the
686county for nonpayment of taxes shall continue to be subject to
687the tax provided by this act.
688     Section 18.  The taxes levied or authorized to be levied by
689this act shall constitute a lien on the lands as of the 1st day
690of January of each year in which such tax is assessed, which
691lien shall be superior in dignity to all other liens upon said
692lands and equal in dignity to the lien for county taxes upon
693said lands.
694     Section 19.  In all respects, not herein otherwise
695specified or provided, the district shall have all power and
696authority conferred by and subject to the provisions of chapter
697298, Florida Statutes (2004), and to general laws appertaining
698now in force, not inconsistent herewith; and all general
699drainage laws not inconsistent with this act shall be applicable
700to said district, as by this act created and established.
701     Section 4.  Chapters 7969 (1919), 8880 (1921), 10671
702(1925), 13654 (1929), 15616 (1931), 17978 (1937), 27310 (1951),
70328382 (1953), 81-481, 88-511, and 89-514, Laws of Florida, are
704repealed.
705     Section 5.  If any clause or section of this act shall be
706declared invalid, it shall not affect the remainder of this act.
707     Section 6.  This act shall take effect upon becoming a law.
