14 | Be It Enacted by the Legislature of the State of Florida: |
15 |
|
16 | Section 1. Pursuant to section 189.429, Florida Statutes, |
17 | this act constitutes the codification of all special acts |
18 | relating to the Hastings Drainage District, Putnam and St. Johns |
19 | Counties. It is the intent of the Legislature in enacting this |
20 | law to provide a single, comprehensive special act charter for |
21 | the district, including all current legislative authority |
22 | granted to the district by its several legislative enactments |
23 | and any additional authority granted by this act. It is further |
24 | the intent of this act to preserve all district authority. |
25 | Section 2. Chapters 7969 (1919), 8880 (1921), 10671 |
26 | (1925), 13654 (1929), 15616 (1931), 17978 (1937), 27310 (1951), |
27 | 28382 (1953), 81-481, 88-511, and 89-514, Laws of Florida, are |
28 | codified, reenacted, amended, and repealed as herein provided. |
29 | Section 3. The charter for the Hastings Drainage District |
30 | is reenacted and re-created to read: |
31 | Section 1. The district is created for the purpose of |
32 | draining, reclaiming, and maintaining the lands hereinafter |
33 | described, and protecting the same from the effects of waters |
34 | for agricultural and sanitary purposes, and for the public |
35 | convenience, utility, welfare, and benefit. |
36 | Section 2. The district retains all rights with respect to |
37 | rights-of-way in the following area and retains the right for |
38 | the normal flow of water through the area described below for |
39 | the protection of the district. Sixteen Mile Creek Water Control |
40 | District shall maintain all said rights-of-way in the following |
41 | area as a part of its water management plan at no charge to the |
42 | district or its landowners. The area is described as follows: |

553 | Section 4. The governing board of the district shall be |
554 | the Board of Supervisors of Hastings Drainage District and shall |
555 | be composed of three persons, all of whom shall be citizens of |
556 | the United States, residents of either St. Johns County or |
557 | Putnam County, and owners of land or stockholders in |
558 | corporations owning land lying within the boundaries of the |
559 | district. The present board of supervisors ("board") and the |
560 | terms of office for its members are as follows: Frank C. Johns, |
561 | Jr., whose term of office expires November 30, 2006; W. W. |
562 | Tilton, Jr., whose term of office expires November 30, 2007; and |
563 | Daniel S. Johns, whose term of office expires November 30, 2005. |
564 | On the third Tuesday in October of each year, the district shall |
565 | call a meeting of the landowners in the district to elect one |
566 | supervisor as successor to the supervisor whose term of office |
567 | will expire the following December, the term of such supervisor |
568 | so elected to begin on the first day of December next following |
569 | his or her election, and that supervisor shall hold office for 3 |
570 | years. The election shall be conducted in accordance with the |
571 | provisions of section 298.11, Florida Statutes. |
572 | Section 5. Immediately after the election or appointment |
573 | of its members, the board shall meet and elect from among its |
574 | members a president. The board shall also elect as secretary |
575 | some suitable person, who may or may not be a member of the |
576 | board. |
577 | Section 6. The board shall cause to be kept a well-bound |
578 | book, entitled "Record of Board of Supervisors of the Hastings |
579 | Drainage District," in which shall be recorded minutes of all |
580 | meetings, proceedings, certificates, bonds given by all |
581 | employees, and all corporate acts, which record shall at all |
582 | reasonable times be open to the inspection of anyone interested. |
583 | Section 7. The board shall have all the powers of a body |
584 | corporate, including the powers to sue and be sued by its name |
585 | in any court of law or equity; to make contracts; to adopt and |
586 | use a common seal and to alter the same at pleasure; to hold, |
587 | buy, and convey such personal and real property that may be |
588 | necessary for the purposes of the district; and to appoint |
589 | agents and employees as the business of the district may |
590 | require. |
591 | Section 8. The board shall report to the landowners, at |
592 | the annual meeting held under the provisions of section 298.12, |
593 | Florida Statutes, any work that has been done, either by |
594 | engineers or otherwise. |
595 | Section 9. Board members shall be reimbursed for their |
596 | travel expenses pursuant to section 112.061, Florida Statutes, |
597 | but shall receive no compensation for their service unless the |
598 | landowners at the annual meeting determine to pay a |
599 | compensation, which in no event may exceed $50 per day for the |
600 | time actually engaged in work for the district and in attending |
601 | sessions of the board. |
602 | Section 10. The board shall appoint a district engineer |
603 | and pay him or her such reasonable salary as may be determined |
604 | necessary and proper, or may contract for engineering work. The |
605 | engineer shall make a report in writing to the board once every |
606 | 12 months or as directed by the board. The report shall describe |
607 | the progress made and activities undertaken in furtherance of |
608 | the water control plan, and may include suggestions and |
609 | recommendations to the board as the engineer deems appropriate. |
610 | Section 11. The board shall select and appoint some |
611 | competent person, bank, or trust company, organized under the |
612 | laws of the state, as treasurer of the district, who shall |
613 | receive and receipt for all the drainage taxes collected by the |
614 | county collector or collectors, and the treasurer shall receive |
615 | and receipt for the proceeds of all tax sales made under the |
616 | provisions of this chapter. The board shall audit or have |
617 | audited the books of the district's treasurer at least once |
618 | every year and make a report thereof to the landowners at the |
619 | annual meeting and publish a statement within 30 days |
620 | thereafter, showing the amount of money received, the amount |
621 | paid out during such year, and the amount in the treasury at the |
622 | beginning and end of the year. A certified copy of the annual |
623 | audit shall be filed with the state auditor. |
624 | Section 12. The board shall employ an attorney to act for |
625 | the district and to advise the board. Such employment shall be |
626 | evidenced by an agreement in writing which, as far as possible, |
627 | shall specify the exact amount to be paid to the attorney for |
628 | all services and expenses. |
629 | Section 13. The board has full power and authority to |
630 | construct, complete, operate, maintain, repair, and replace any |
631 | and all works and improvements necessary to execute the |
632 | district's water control plan, including all of the powers |
633 | conferred on the district by sections 298.22 and 298.23, Florida |
634 | Statutes. |
635 | Section 14. For the purposes of this act, and particularly |
636 | for the purpose of levying and imposing taxes and assessments |
637 | hereinafter levied and imposed, or authorized to be levied and |
638 | imposed, the territory lying and being within the Hastings |
639 | Drainage District is hereby divided and constituted into zones |
640 | as referenced in section 3. |
641 | Section 15. (1) The taxes and assessments in this act |
642 | levied and authorized to be levied shall be used exclusively for |
643 | the several purposes, uses, and objects specified in this act. |
644 | An annual tax not to exceed $20 per acre per year is authorized |
645 | to be levied by the board. Said tax may vary from zone to zone |
646 | but shall be uniform within a zone. |
647 | (2) Any parcel of land less than 1 acre in area shall bear |
648 | only its proportionate part of the tax authorized by this act to |
649 | be levied. |
650 | (3) For the purpose of enabling the board to carry out the |
651 | purposes of this act, the Legislature hereby finds such tax is a |
652 | reasonable tax on all such lands, and that said lands are and |
653 | will be benefited in excess of the amount of the tax hereby |
654 | levied. |
655 | Section 16. The board shall annually prepare a list of all |
656 | the lands included in the district, showing the zone and tax, |
657 | and shall transmit such list to the Tax Assessor of Putnam |
658 | County and to the Tax Assessor of St. Johns County, who shall |
659 | enter annually upon the county tax rolls the aforesaid levy, |
660 | including the tax for the district in his or her warrant as |
661 | prescribed by law, and such drainage tax shall be collected by |
662 | the Tax Collector of Putnam County and the Tax Collector of St. |
663 | Johns County at the same time and as other county taxes on real |
664 | estate are collected, and such tax collectors shall deposit the |
665 | same to the credit of the board created by this act, furnishing |
666 | said board with a statement of the amount thereof. Said money |
667 | shall be used only for the purposes provided herein, after |
668 | paying the cost of assessing said lands, which is hereby |
669 | estimated at 2 percent, and the tax collectors' fees, as fixed |
670 | by law. |
671 | Section 17. (1) On the nonpayment of drainage taxes on |
672 | any parcel of land lying within said district, the drainage tax |
673 | shall be treated in the same manner as any other unpaid county |
674 | taxes and shall be included in the tax certificates issued |
675 | thereon; and on redemption or purchase of a certificate which |
676 | includes an item of the district taxes, the tax collector or |
677 | clerk shall pay over to the board the amount of such drainage |
678 | taxes and interest included in said certificate. |
679 | (2) Where title to any lands lying in the district is |
680 | vested in Putnam County or St. Johns County and sold, the clerk |
681 | of the circuit court in the county wherein any such parcel is |
682 | situate shall disburse to the district the percentage of the net |
683 | sum received from the sale of the land in the same proportion as |
684 | the amount of drainage tax bore to the total tax on said parcel |
685 | outstanding at the time of sale. The lands when sold by the |
686 | county for nonpayment of taxes shall continue to be subject to |
687 | the tax provided by this act. |
688 | Section 18. The taxes levied or authorized to be levied by |
689 | this act shall constitute a lien on the lands as of the 1st day |
690 | of January of each year in which such tax is assessed, which |
691 | lien shall be superior in dignity to all other liens upon said |
692 | lands and equal in dignity to the lien for county taxes upon |
693 | said lands. |
694 | Section 19. In all respects, not herein otherwise |
695 | specified or provided, the district shall have all power and |
696 | authority conferred by and subject to the provisions of chapter |
697 | 298, Florida Statutes (2004), and to general laws appertaining |
698 | now in force, not inconsistent herewith; and all general |
699 | drainage laws not inconsistent with this act shall be applicable |
700 | to said district, as by this act created and established. |
701 | Section 4. Chapters 7969 (1919), 8880 (1921), 10671 |
702 | (1925), 13654 (1929), 15616 (1931), 17978 (1937), 27310 (1951), |
703 | 28382 (1953), 81-481, 88-511, and 89-514, Laws of Florida, are |
704 | repealed. |
705 | Section 5. If any clause or section of this act shall be |
706 | declared invalid, it shall not affect the remainder of this act. |
707 | Section 6. This act shall take effect upon becoming a law. |
