5     Section 7.  This act may be cited as the "Dori Slosberg
6Safety Belt Law."
7     Section 8.  Subsection (8) of section 316.614, Florida
8Statutes, is amended to read:
9     316.614  Safety belt usage.--
10     (8)  Any person who violates the provisions of this section
11commits a nonmoving violation, punishable as provided in chapter
12318. By January 1, 2006, each law enforcement agency in this
13state shall adopt departmental policy to prohibit the practice
14of racial profiling. When a law enforcement officer issues a
15citation for a violation of this section, the law enforcement
16officer must record the race and ethnicity of the violator. All
17law enforcement agencies must maintain such information and
18forward the information to the department in a form and manner
19determined by the department. The department shall collect this
20information by jurisdiction and annually report the data to the
21Governor, the President of the Senate, and the Speaker of the
22House of Representatives. The report must show separate
23statewide totals for the state's county sheriffs and municipal
24law enforcement agencies, state law enforcement agencies, and
25state university law enforcement agencies. However, except for
26violations of s. 316.613, enforcement of this section by state
27or local law enforcement agencies must be accomplished only as a
28secondary action when a driver of a motor vehicle has been
29detained for a suspected violation of another section of this
30chapter, chapter 320, or chapter 322.

45for enforcement of the Florida Safety Belt Law as a secondary
46action; providing effective dates.
