A bill to be entitled
2An act relating to public records; creating s. 551.1078,
3F.S.; providing an exemption from public records
4requirements for nonessential private information supplied
5by applicants pursuant to an application filed for the
6purpose of securing a license as a slot machine gaming
7licensee and trade secrets supplied by any entity under
8ch. 551, F.S., for such purpose; providing for review and
9repeal; providing a statement of public necessity;
10providing an effective date.

12Be It Enacted by the Legislature of the State of Florida:
13
14     Section 1.  Section 551.1078, Florida Statutes, is created
15to read:
16     551.1078  Public records exemption; nonessential private
17information of applicants for licensure; trade secrets.--
18     (1)  Nonessential private information supplied by
19applicants pursuant to an application filed for the purpose of
20securing a license as a slot machine gaming licensee and trade
21secrets supplied by any entity under this chapter for such
22purpose are exempt from s. 119.07(1) and s. 24(a), Art. I of the
23State Constitution.
24     (2)  Subsection (1) is subject to the Open Government
25Sunset Review Act of 1995 in accordance with s. 119.15 and shall
26stand repealed on October 2, 2010, unless reviewed and saved
27from repeal through reenactment by the Legislature.
28     Section 2.  It is the finding of the Legislature that
29nonessential private information supplied by applicants pursuant
30to an application filed for the purpose of securing a license as
31a slot machine gaming licensee and trade secrets supplied by any
32entity under chapter 551, Florida Statutes, for such purpose
33must be kept confidential and exempt from s. 119.07(1) and s.
3424(a), Art. I of the State Constitution in order to protect
35sensitive personal and financial information contained in
36applications filed with the Division of Pari-mutuel Wagering and
37Slot Machines of the Department of Business and Professional
38Regulation and to protect confidential information about
39entities filing such applications.
40     Section 3.  This act shall take effect on the same date
41that HB 1569 or similar legislation takes effect, if such
42legislation is adopted in the same legislative session or an
43extension thereof and becomes law.
