  1                      A bill to be entitled

  2         An act relating to the Scripps Florida Funding

  3         Corporation; amending s. 288.955, F.S.;

  4         providing that the board of directors of the

  5         corporation shall have the exclusive right to

  6         select a provider or providers of water and

  7         wastewater facilities for the biomedical

  8         research institution and campus to be

  9         established by The Scripps Research Institute;

10         specifying considerations with respect to the

11         selection of a service provider by the board;

12         repealing section 4, ch. 2003-420, Laws of

13         Florida, relating to the authority of the

14         county in which a facility established under s.

15         288.955, F.S., is located to provide water and

16         wastewater services; providing an effective

17         date.

19  Be It Enacted by the Legislature of the State of Florida:

20  

21         Section 1.  Subsection (6) of section 288.955, Florida

22  Statutes, is amended to read:

23         288.955  Scripps Florida Funding Corporation.--

24         (6)  POWERS AND DUTIES.--

25         (a)  The corporation is organized to receive, hold,

26  invest, administer, and disburse funds appropriated by the

27  Legislature in support of this section and to disburse any

28  income generated from the investment of these funds consistent

29  with the purpose and provisions of this section. In addition

30  to the powers and duties prescribed in chapter 617 and the

 1  articles and bylaws adopted under that chapter, the

 2  corporation:

 3         1.(a)  May make and enter into contracts and assume any

 4  other functions that are necessary to carry out the provisions

 5  of this section.

 6         2.(b)  May enter into leases and contracts for the

 7  purchase of real property and hold notes, mortgages,

 8  guarantees, or security agreements to secure the performance

 9  of obligations of the grantee under the contract.

10         3.(c)  May perform all acts and things necessary or

11  convenient to carry out the powers expressly granted in this

12  section and a contract entered into between the corporation

13  and the grantee.

14         4.(d)  May make expenditures, from funds provided by

15  this state, including any necessary administrative

16  expenditures consistent with its powers.

17         5.(e)  May indemnify, and purchase and maintain

18  insurance on behalf of, directors, officers, and employees of

19  the corporation against any personal liability or

20  accountability.

21         6.(f)  Shall disburse funds pursuant to the provisions

22  of this section and a contract entered into between the

23  corporation and the grantee.

24         7.(g)  Shall receive and review reports and financial

25  documentation provided by the grantee to ensure compliance

26  with the provisions of this section and provisions of the

27  contract.

28         8.(h)  Shall prepare an annual report as prescribed in

29  subsection (14).

30         (b)  Notwithstanding any other law to the contrary, the

31  board of directors shall have the exclusive right to select a

 1  provider or providers of water and wastewater facilities for

 2  the biomedical research institution and campus. All public

 3  agencies in the county having legislative authority to provide

 4  service shall be invited to submit service proposals. In its

 5  selection of a service provider or providers the board shall

 6  consider the cost of the utility service, current availability

 7  of existing facilities, capital costs to a utility provider to

 8  extend such service to the institution and campus, and such

 9  other factors it deems relevant.

10         Section 2.  Section 4 of chapter 2003-420, Laws of

11  Florida, is repealed.

12         Section 3.  This act shall take effect upon becoming a

13  law.
