2 An act relating to the Scripps Funding
3 Corporation; amending s. 4 of ch. 2003-420,
4 Laws of Florida; prohibiting the use of eminent
5 domain against other governmental entities
6 under certain circumstances; providing an
7 effective date.

9 Be It Enacted by the Legislature of the State of Florida:

11 Section 1. Section 4 of ch. 2003-420, Laws of Florida,
12 is amended to read:
13 Section 4. Notwithstanding any other provision of law,
14 the county in which the projects that are part of or ancillary
15 to the state-of-the-art biomedical research institution and
16 campus to be established in this state by the grantee under
17 section 288.955, Florida Statutes, are to be located shall
18 have the exclusive right, which right may be assigned in whole
19 or in part by the governing body of the county in its sole
20 discretion, to provide water and wastewater services to such
21 projects to the extent deemed necessary by the governing body
22 of the county. The county may plan, acquire, construct,
23 reconstruct, enlarge or extend, operate, and maintain water
24 and wastewater systems and facilities within or without the
25 boundaries of such projects for the provision of water and
26 wastewater services. Provided, the local government or utility
27 service provider shall not be authorized to use the provisions
28 of chapter 73 or chapter 74, Florida Statutes, or any other
29 applicable law, to acquire by eminent domain the property of
30 any other governmental entity in order to provide water and

1 waste-water service to the biomedical research facility
2 authorized pursuant to section 288.955, Florida Statutes.
3 Section 2. This act shall take effect upon becoming a
4 law.

6 STATEMENT OF SUBSTANTIAL CHANGES CONTAINED IN
COMMITTEE SUBSTITUTE FOR
7 Senate Bill 1572

9 The committee substitute deletes the proposed authority for
Scripps Corporation to select a water and waste-water
10 provider. Instead, Palm Beach County is prohibited from using
eminent domain actions against other governmental entities in
11 order to provide water and waste-water service to the Scripps
biomedical research facility.
