3     Amendment to Amendment (426201) (with title amendment)
4Between line(s) 2098 and 2099, insert:
5     Section 45.  Subsection (2) of section 106.08, Florida
6Statutes, is amended to read:
7     106.08  Contributions; limitations on.--
8     (2)(a)  Except as otherwise provided in paragraph (b), a
9candidate may not accept contributions from national, state,
10including any subordinate committee of a national, state, or
11county committee of a political party, and county executive
12committees of a political party, which contributions in the
13aggregate exceed $50,000, no more than $25,000 of which may be
14accepted prior to the 28-day period immediately preceding the
15date of the general election.
16     (b)  A candidate for statewide office may not accept
17contributions from national, state, including any subordinate
18committee of a national, state, or county committee of a
19political party, and county executive committees of a political
20party, which contributions in the aggregate exceed $250,000, no
21more than $125,000 of which may be accepted prior to the 28-day
22period immediately preceding the date of the general election.
23     (c)(b)  Polling services, research services, costs for
24campaign staff, professional consulting services, and telephone
25calls are not contributions to be counted toward the
26contribution limits of paragraph (a) or paragraph (b). Any item
27not expressly identified in this paragraph as nonallocable is a
28contribution in an amount equal to the fair market value of the
29item and must be counted as allocable toward the $50,000
30contribution limits of paragraph (a) or the $250,000
31contribution limits of paragraph (b). Nonallocable, in-kind
32contributions must be reported by the candidate under s. 106.07
33and by the political party under s. 106.29.
