14 initial effective date of the enterprise zone;
15 requiring the Office of Program Policy Analysis
16 and Government Accountability to conduct a
17 study of rural enterprise zone issues and to
18 submit a report to the Legislature; providing
19 an effective date.

21 Be It Enacted by the Legislature of the State of Florida:
22
23 Section 1. Section 290.00710, Florida Statutes, is
24 created to read:
25 290.00710 Enterprise zone designation for the City of
26 Lakeland.--The City of Lakeland may apply to the Office of
27 Tourism, Trade, and Economic Development for designation of
28 one enterprise zone for an area within the City of Lakeland,
29 which zone shall encompass an area up to 10 square miles. The
30 application must be submitted by December 31, 2005, and must
31 comply with the requirements of s. 290.0055. Notwithstanding

1 s. 290.0065, limiting the total number of enterprise zones
2 designated and the number of enterprise zones within a
3 population category, the Office of Tourism, Trade, and
4 Economic Development may designate one enterprise zone under
5 this section. The Office of Tourism, Trade, and Economic
6 Development shall establish the initial effective date of the
7 enterprise zone designated pursuant to this section.
8 Section 2. Section 290.0073, Florida Statutes, is
9 created to read:
10 290.0073 Enterprise zone designation for Indian River
11 County, the City of Vero Beach, and the City of
12 Sebastian.--Indian River County, the City of Vero Beach, and
13 the City of Sebastian may jointly apply to the Office of
14 Tourism, Trade, and Economic Development for designation of
15 one enterprise zone encompassing an area not to exceed 10
16 square miles. The application must be submitted by December
17 31, 2005, and must comply with the requirements of s.
18 290.0055. Notwithstanding the provisions of s. 290.0065
19 limiting the total number of enterprise zones designated and
20 the number of enterprise zones within a population category,
21 the Office of Tourism, Trade, and Economic Development may
22 designate one enterprise zone under this section. The Office
23 of Tourism, Trade, and Economic Development shall establish
24 the initial effective date of the enterprise zone designated
25 pursuant to this section.
26 Section 3. Section 290.0074, Florida Statutes, is
27 created to read:
28 290.0074 Enterprise zone designation for Sumter
29 County.--Sumter County may apply to the Office of Tourism,
30 Trade, and Economic Development for designation of one
31 enterprise zone encompassing an area not to exceed 10 square

11 created to read:
12 290.00755 Enterprise zone designation for Columbia
13 County or Columbia County and Lake City.--Columbia County, or
14 Columbia County and the municipality of Lake City jointly, may
15 apply to the Office of Tourism, Trade, and Economic
16 Development for designation of one enterprise zone
17 encompassing an area within the county, or within the county
18 and the municipality. The application must be submitted by
19 December 31, 2005. Notwithstanding the provisions of s.
20 290.0065 limiting the total number of enterprise zones
21 designated and the number of enterprise zones within a
22 population category, the Office of Tourism, Trade, and
23 Economic Development may designate one enterprise zone under
24 this section. The Office of Tourism, Trade, and Economic

26 enterprise zone designated pursuant to this section.
27 Section 5. Section 290.0076, Florida Statutes, is

21 provisions of s. 290.0055. Notwithstanding the provisions of
22 s. 290.0065 limiting the total number of enterprise zones
23 designated and the number of enterprise zones within a
24 population category, the Office of Tourism, Trade, and
25 Economic Development may designate one enterprise zone under
26 this section. The Office of Tourism, Trade, and Economic
27 Development shall establish the initial effective date of the
28 enterprise zone designated pursuant to this section.
29 Section 7. The Office of Program Policy Analysis and
30 Government Accountability shall conduct an evaluation of the
31 tax incentives available to rural enterprise zones and the

1 effectiveness of rural enterprise zones in creating jobs. In
2 particular, the evaluation must consider whether existing tax
3 and other financial incentives available under the Enterprise
4 Zone Act are appropriate for businesses located in rural
5 enterprise zones and whether incentives such as the transfer
6 of unused tax credits would enhance the effectiveness of rural
7 enterprise zones. The evaluation shall include an estimation
8 of the costs of new tax incentives. The evaluation shall also
9 identify obstacles faced by rural enterprise zones and
10 recommend possible solutions. The Office of Program Policy
11 Analysis and Government Accountability shall conduct its
12 evaluation and submit a report containing its findings and
13 recommendations to the Legislature by December 1, 2005.
14 Section 8. This act shall take effect July 1, 2005.

19 The committee substitute for committee substitute for
committee substitute (CS) authorizes the following additional
20 local governments to apply to the Office of Tourism, Trade,
and Economic Development (OTTED) for the designation of one
21 enterprise zone: Columbia County with or without the city of
Lake City; Suwannee County with or without the city of Live
22 Oak; and Orange County and the City of Apopka. It also
directs the Office of Program Policy Analysis and Government
23 Accountability to conduct an evaluation of the tax incentives
available to rural enterprise zones and the effectiveness of
24 these zones in creating jobs.
