  2         An act relating to recreational licenses and

  3         permits; amending s. 372.57, F.S.; providing

  4         for a military gold sportsman's license;

  5         providing for an annual fee; providing

  6         authorizations allowed under license; providing

  7         eligibility requirements; amending ss.

  8         372.5712, 372.5715, and 372.573, F.S.;

  9         providing for uses of specified pro rata

10         portions of revenue generated from the military

11         gold sportsman's license; amending s. 372.661,

12         F.S.; exempting patrons of licensed hunting

13         preserves from the license and permit

14         requirements of the military gold sportsman's

15         license while hunting on the licensed preserve

16         property; providing an effective date.

18  Be It Enacted by the Legislature of the State of Florida:

19  

20         Section 1.  Paragraph (j) is added to subsection (4) of

21  section 372.57, Florida Statutes, to read:

22         372.57  Recreational licenses, permits, and

23  authorization numbers; fees established.--

24         (4)  RESIDENT HUNTING AND FISHING LICENSES.--The

25  licenses and fees for residents participating in hunting and

26  fishing activities in this state are as follows:

27         (j)  Annual military gold sportsman's license, $18.50.

28  The gold sportsman's license authorizes the person to whom it

29  is issued to take freshwater fish, saltwater fish, and game,

30  subject to the state and federal laws, rules, and regulations,

31  including rules of the commission, in effect at the time of

 1  taking. Other authorized activities include activities

 2  authorized by a management area permit, a muzzle-loading gun

 3  permit, a turkey permit, a Florida waterfowl permit, an

 4  archery permit, a snook permit, and a crawfish permit. Any

 5  resident who is an active or retired member of the United

 6  States Armed Forces, the United States Armed Forces Reserve,

 7  the National Guard, the United States Coast Guard, or the

 8  United States Coast Guard Reserve is eligible to purchase the

 9  military gold sportsman's license upon submission of a current

10  military identification card.

11         Section 2.  Subsection (1) of section 372.5712, Florida

12  Statutes, is amended to read:

13         372.5712  Florida waterfowl permit revenues.--

14         (1)  The commission shall expend the revenues generated

15  from the sale of the Florida waterfowl permit as provided in

16  s. 372.57(8)(a) or that pro rata portion of any license that

17  includes waterfowl hunting privileges, as provided in s.

18  372.57(4)(h), (i), and (j) and (9)(a)3. s. 372.57(4)(h) and

19  (i) and (9)(a)3. as follows:  A maximum of 5 percent of the

20  gross revenues shall be expended for administrative costs; a

21  maximum of 25 percent of the gross revenues shall be expended

22  for waterfowl research approved by the commission; and a

23  maximum of 70 percent of the gross revenues shall be expended

24  for projects approved by the commission, in consultation with

25  the Waterfowl Advisory Council, for the purpose of protecting

26  and propagating migratory waterfowl and for the development,

27  restoration, maintenance, and preservation of wetlands within

28  the state.

29         Section 3.  Subsection (1) of section 372.5715, Florida

30  Statutes, is amended to read:

31         372.5715  Florida wild turkey permit revenues.--

 1         (1)  The commission shall expend the revenues generated

 2  from the sale of the turkey permit as provided for in s.

 3  372.57(8)(b) or that pro rata portion of any license that

 4  includes turkey hunting privileges as provided for in s.

 5  372.57(4)(h), (i), and (j) s. 372.57(4)(h) and (i) for

 6  research and management of wild turkeys.

 7         Section 4.  Section 372.573, Florida Statutes, is

 8  amended to read:

 9         372.573  Management area permit revenues.--The

10  commission shall expend the revenue generated from the sale of

11  the management area permit as provided for in s. 372.57(8)(h)

12  or that pro rata portion of any license that includes

13  management area privileges as provided for in s. 372.57(4)(h),

14  (i), and (j) s. 372.57(4)(h) and (i) for the lease,

15  management, and protection of lands for public hunting,

16  fishing, and other outdoor recreation.

17         Section 5.  Subsection (2) of section 372.661, Florida

18  Statutes, is amended to read:

19         372.661  Private hunting preserve license fees;

20  exception.--

21         (2)  A commercial hunting preserve license, which shall

22  exempt patrons of licensed preserves from the license and

23  permit requirements of s. 372.57(4)(c), (d), (f), (h), (i),

24  and (j); (5)(f) and (g); (8)(a), (b), (e), and (f); (9)(a)2.;

25  (11); and (12) s. 372.57(4)(c), (d), (f), (h), and (i); (5)(f)

26  and (g); (8)(a), (b), (e), and (f); (9)(a)2.; (11); and (12)

27  while hunting on the licensed preserve property, shall be

28  $500. Such commercial hunting preserve license shall be

29  available only to those private hunting preserves licensed

30  pursuant to this section which are operated exclusively for

31  commercial purposes, which are open to the public, and for

 1  which a uniform fee is charged to patrons for hunting

 2  privileges.

 3         Section 6.  This act shall take effect upon becoming a

 4  law.

 6          STATEMENT OF SUBSTANTIAL CHANGES CONTAINED IN
                       COMMITTEE SUBSTITUTE FOR
 7                         Senate Bill 1610

 8                                 

 9  Instead of providing an exemption from freshwater, saltwater
    and hunting licensing provisions for active and retired
10  Florida military personnel, the committee substitute creates
    the annual military gold sportsman's license for $18.50. The
11  military gold sportsman's license covers all residential
    hunting and fishing licenses for such military personnel,
12  including activities authorized by a management area,
    muzzle-loading gun, turkey, Florida waterfowl, archery, snook,
13  and crawfish permit.
