11  The Committee on Health and Human Services Appropriations
12  (Pruitt) recommended the following amendment:
13  
14         Senate Amendment (with title amendment) 
15         Delete everything after the enacting clause
16  
17  and insert:  
18         Section 1.  Subsection (6) of section 400.602, Florida
19  Statutes, is amended and subsection (7) is added to that
20  section, to read:
21         400.602  Licensure required; prohibited acts;
22  exemptions; display, transferability of license.--
23         (6)  Notwithstanding subsection (7) and s. 400.601(3),
24  at any time after July 1, 1995, any entity entitled to
25  licensure under subsection (5) may obtain a license for up to
26  two additional hospices in accordance with the other
27  requirements of this part and upon receipt of any certificate
28  of need that may be required under the provisions of ss.
29  408.031-408.045.
30         (7)(a)  Notwithstanding the provisions of s.
31  400.601(3), any hospice that is organized as a for-profit

Florida Senate - 2005 COMMITTEE AMENDMENT Bill No. CS for SB 1622 Barcode 561448 1 corporation and provides a continuum of palliative and 2 supportive care for a terminally ill patient and his or her 3 family may obtain a license in accordance with the other 4 requirements of this part and upon receipt of any certificate 5 of need required under ss. 408.031-408.045 to provide care in: 6 1. Hospice services areas having populations of 7 750,000 or more, except that it may not be located in any 8 county in the service area which has a a population of 550,000 9 or less; or 10 2. A hospice service area in which a for-profit 11 hospice is currently licensed to operate under subsections (5) 12 or (6). 13 (b) The Agency for Health Care Administration shall 14 use hospice service areas as published on January 1, 2005. No 15 later than January 1, 2007, the Agency for Health Care 16 Administration shall submit to the Legislature a report 17 analyzing the impact of for-profit hospices on the delivery of 18 care to terminally ill patients, including a review of the 19 quality of care, the change in the competitive marketplace, 20 and any other relevant information. 21 Section 2.
