| 2 | An act relating to voyeurism; amending s. 810.14, F.S.; |
| 3 | revising the elements of the offense of voyeurism in order |
| 4 | to eliminate acts of photographing, filming, videotaping, |
| 5 | or recording, which are made a crime under the offense of |
| 6 | video voyeurism; providing that a person commits the |
| 7 | offense of voyeurism when he or she secretly observes |
| 8 | another person while the other person is in a location |
| 9 | that provides a reasonable expectation of privacy; |
| 10 | providing an effective date. |

| 12 | Be It Enacted by the Legislature of the State of Florida: |
| 13 |
|
| 14 | Section 1. Section 810.14, Florida Statutes, is amended to |
| 15 | read: |
| 16 | 810.14 Voyeurism prohibited; penalties.-- |
| 17 | (1) A person commits the offense of voyeurism when he or |
| 18 | she, with lewd, lascivious, or indecent intent, secretly |
| 19 | observes, photographs, films, videotapes, or records another |
| 20 | person when the such other person is located in a dwelling, |
| 21 | structure, or conveyance and such location provides a reasonable |
| 22 | expectation of privacy. |
| 23 | (2) A person who violates this section commits a |
| 24 | misdemeanor of the first degree for the first violation, |
| 25 | punishable as provided in s. 775.082 or s. 775.083. |
| 26 | (3) A person who violates this section and who has been |
| 27 | previously convicted or adjudicated delinquent two or more times |
| 28 | of any violation of this section commits a felony of the third |
| 29 | degree, punishable as provided in s. 775.082, s. 775.083, or s. |
| 30 | 775.084. |
| 31 | (4) For purposes of this section, a person has been |
| 32 | previously convicted or adjudicated delinquent of a violation of |
| 33 | this section if the violation resulted in a conviction sentenced |
| 34 | separately, or an adjudication of delinquency entered |
| 35 | separately, prior to the current offense. |
| 36 | Section 2. This act shall take effect July 1, 2005. |
