5 | proceeds of the local government infrastructure surtax |
6 | authorized under s. 212.055(2), F.S., may include a |
7 | covenant to decrease capital local school property taxes |
8 | or to discontinue the surtax in certain circumstances; |
9 | providing an effective date. |

11 | Be It Enacted by the Legislature of the State of Florida: |
12 |

13 | Section 1. Section 1011.715, Florida Statutes, is amended |
14 | to read: |
15 | 1011.715 Resolution regarding school capital outlay |
16 | surcharge or local government infrastructure surtax.--The |
17 | resolution of a district school board providing for the |
18 | imposition of the school capital outlay surtax authorized in s. |
19 | 212.055(6) or providing for the receipt of proceeds of the local |
20 | government infrastructure surtax authorized under s. 212.055(2) |
21 | may include a covenant by the district school board to decrease |
22 | the capital local school property tax levied pursuant to s. |
23 | 1011.71(2) and to maintain that tax at the reduced millage as |
24 | long as the surtax is in effect. The resolution may also |
25 | provide that the surtax shall sunset on December 31 of any year |
26 | in which the district school board levies the capital property |
27 | tax under s. 1011.71(2) at a millage rate in excess of the |
28 | reduced millage rate promised in the resolution. Finally, if |
29 | the surtax revenues are pledged to service bonded indebtedness, |
30 | the district school board may covenant not to levy the capital |
31 | property tax under s. 1011.71(2) at a millage rate in excess of |
32 | the reduced millage rate promised in the resolution. |
33 | Section 2. This act shall take effect upon becoming a law. |
