19 Section 5. Subsections (1), (2), (6), (7), (8), (9),
20 and (11) of section 445.007, Florida Statutes, are amended to
21 read: 445.007 Regional workforce boards; exemption from
22 public meetings law.--
23 (1) One regional workforce board shall be appointed in
24 each designated service delivery area and shall serve as the
25 local workforce investment board pursuant to Pub. L. No.
26 105-220. The membership of the board shall be consistent with
27 Pub. L. No. 105-220, Title I, s. 117(b), and contain one
28 representative from a nonpublic postsecondary educational
29 institution that is an authorized individual training account
30 provider within the region and confers certificates and
31 diplomas, one representative from a nonpublic postsecondary

1 educational institution that is an authorized individual
2 training account provider within the region and confers
3 degrees, and three representatives of organized labor. The
4 board shall include one nonvoting representative from a
5 military installation if a military installation is located
6 within the region and the appropriate military command or
7 organization authorizes such representation. Individuals
8 serving as members of regional workforce development boards or
9 local WAGES coalitions, as of June 30, 2000, are eligible for
10 appointment to regional workforce boards, pursuant to this
11 section. It is the intent of the Legislature that, whenever
12 possible and to the greatest extent practicable, membership of
13 a regional workforce board include persons who are current or
14 former recipients of welfare transition assistance as defined
15 in s. 445.002(3) or workforce services as provided in s.
16 445.009(1), or that such persons be included as ex officio
17 members of the board or of committees organized by the board.
18 The importance of minority and gender representation shall be
19 considered when making appointments to the board. The board,
20 its committees, subcommittees, and subdivisions, and other
21 units of the workforce system, including units that may
22 consist in whole or in part of local governmental units, may
23 use any method of telecommunications to conduct meetings,
24 including establishing a quorum through telecommunications,
25 provided that the public is given proper notice of the
26 telecommunications meeting and reasonable access to observe
27 and, when appropriate, participate. Regional workforce boards
28 are subject to those provisions of chapter 119 which relate to
29 public records and those provisions of chapter 286 which
30 relate to public meetings. If the regional workforce board
31 enters into a contract with an organization or individual

1 represented on the board of directors, the contract must be
2 approved by a two-thirds vote of the entire board, and the
3 board member who could benefit financially from the
4 transaction must abstain from voting on the contract. A board
5 member must disclose any such conflict in a manner that is
6 consistent with the procedures outlined in s. 112.3143.
7 (2) The regional workforce board shall elect a chair
8 from among the representatives described in Pub. L. No.
9 105-220, Title I, s. 117(b)(2)(A)(i) to serve for a term of no
10 more than 2 years and shall serve no more than two terms.
11 Workforce Florida, Inc., will determine the timeframe and
12 manner of changes to the regional workforce boards as required
13 by this chapter and Pub. L. No. 105-220.
14 (6) Regional workforce boards shall adopt a committee
15 structure consistent with applicable federal law and state
16 policies established by Workforce Florida, Inc. Regional
17 workforce boards may appoint local committees to obtain
18 technical assistance on issues of importance, including those
19 issues affecting older workers.
20 (7) Each regional workforce board shall establish by
21 October 1, 2000, a High Skills/High Wages committee consisting
22 of at least five private-sector business representatives
23 appointed in consultation with local chambers of commerce by
24 the primary county economic development organization within
25 the region, as identified by Enterprise Florida, Inc.; a
26 representative of each primary county economic development
27 organization within the region; the regional workforce board
28 chair; the presidents of all community colleges within the
29 board's region; those district school superintendents with
30 authority for conducting postsecondary educational programs
31 within the region; and two representatives from nonpublic

1 postsecondary educational institutions that are authorized
2 individual training account providers within the region,
3 appointed by the chair of the regional workforce board. If
4 possible, one of the nonpublic educational institutions
5 represented must be accredited by the Southern Association of
6 Colleges and Schools. The business representatives appointed
7 by the primary county economic development organizations need
8 not be members of the regional workforce board and shall
9 represent those industries that are of primary importance to
10 the region's current and future economy. In a multicounty
11 region, each primary county economic development organization
12 within the region shall appoint at least one business
13 representative and shall consult with the other primary county
14 economic development organizations within the region to make
15 joint appointments when necessary.
16 (a) At least annually, each High Skills/High Wages
17 committee shall submit recommendations to Workforce Florida,
18 Inc., related to:
19 1. Policies to enhance the responsiveness of High
20 Skills/High Wages programs in its region to business and
21 economic development opportunities.
22 2. Integrated use of state education and federal
23 workforce development funds to enhance the training and
24 placement of designated population individuals with local
25 businesses and industries.
26 (b) The committees shall also make reports to
27 Workforce Florida, Inc., annually, on dates specified by
28 Workforce Florida, Inc., that identify occupations in the
29 region deemed critical to business retention, expansion, and
30 recruitment activities, based on guidelines set by Workforce
31 Florida, Inc. Such guidelines shall include research of the

1 workforce needs of private employers in the region, in
2 consultation with local chambers of commerce and economic
3 development organizations. Occupations identified pursuant to
4 this paragraph shall be considered by Workforce Florida, Inc.,
5 for inclusion in the region's targeted occupation list.
6 (8) Each regional workforce board shall establish a
7 Better Jobs/Better Wages committee consisting of at least five
8 members. Initial appointments to this committee shall include
9 at least three members of the local WAGES coalition,
10 established pursuant to chapter 96-175, Laws of Florida.
11 (9) Each regional workforce board shall establish a
12 First Jobs/First Wages committee consisting of at least five
13 members. This committee shall serve as the youth council for
14 purposes of Pub. L. No. 105-220.
15 (11) For purposes of procurement, regional workforce
16 boards and their administrative entities are not state
17 agencies, but the boards and their administrative entities
18 must comply with state procurement laws and procedures until
19 Workforce Florida, Inc., adopts the provisions or alternative
20 procurement procedures that meet the requirements of federal
21 law. Regional workforce boards, their administrative entities,
22 committees, and subcommittees, and other workforce units may
23 promote appropriate activities, incentives, and awards for
24 performance by units of Florida's workforce system, and
25 expenditures for such activities, incentives, and awards are
26 not subject to chapter 287 or chapter 17, including rules
27 adopted thereunder. However, all expenditures for such
28 activities, incentives, and awards are exclusively subject to
29 federal regulations applicable to the expenditure of federal
30 funds. All contracts executed by regional workforce boards
31 must include specific performance expectations and
