12 | Medicine; requiring the board to adopt implementing rules; |
13 | providing an effective date. |

15 | Be It Enacted by the Legislature of the State of Florida: |
16 |

17 | Section 1. Paragraph (j) is added to subsection (4) of |
18 | section 400.9905, Florida Statutes, to read: |
19 | 400.9905 Definitions.-- |
20 | (4) "Clinic" means an entity at which health care services |
21 | are provided to individuals and which tenders charges for |
22 | reimbursement for such services, including a mobile clinic and a |
23 | portable equipment provider. For purposes of this part, the term |
24 | does not include and the licensure requirements of this part do |
25 | not apply to: |
26 | (j) Clinical facilities affiliated with a college of |
27 | chiropractic accredited by the Council on Chiropractic Education |
28 | at which training is provided for chiropractic students. |
29 | Section 2. Section 460.4064, Florida Statutes, is created |
30 | to read: |
31 | 460.4064 Chiropractic college-based internships; |
32 | registration of participating chiropractic interns.-- |
33 | (1) It is the intent of the Legislature to authorize and |
34 | encourage the participation of chiropractic students in |
35 | internship programs based in clinics associated with colleges of |
36 | chiropractic accredited by the Council on Chiropractic |
37 | Education. Such chiropractic college-based internships are an |
38 | alternative to the community-based internships provided in s. |
39 | 460.402(6). |
40 | (2) Any chiropractic student desiring to provide |
41 | chiropractic treatment as a chiropractic intern participating in |
42 | a chiropractic college-based internship program shall apply to |
43 | the department to be registered as a chiropractic intern and |
44 | remit a fee, not to exceed $100, as set by the board. The |
45 | department shall register any applicant the board certifies |
46 | meets the following requirements: |
47 | (a) Is at least 21 years of age. |
48 | (b) Has not committed any act or offense within or outside |
49 | the state that would constitute the basis for disciplinary |
50 | action under this chapter or chapter 456. |
51 | (c) Is not currently under investigation in any state for |
52 | an act or offense that would constitute the basis for |
53 | disciplinary action under this chapter or chapter 456. |
54 | (3) Registration under this section is valid for a period |
55 | of 1 year and may be renewed upon payment of a renewal fee, not |
56 | to exceed $100, as set by the board. |
57 | (4) A chiropractic student is eligible to register as a |
58 | chiropractic intern under this section only if the chiropractic |
59 | college-based internship program has been approved by the board. |
60 | The board shall approve a chiropractic college-based internship |
61 | program if the program meets the following requirements: |
62 | (a) The program shall meet current Council on Chiropractic |
63 | Education standards for consumer protection. |
64 | (b) The program shall be an established component of the |
65 | curriculum offered by the college of chiropractic. |
66 | (c) The program shall require all interns who participate |
67 | in the program to meet all requirements for internship as |
68 | established by the Council on Chiropractic Education. |
69 | (d) The program shall provide for supervision of interns |
70 | by full-time or adjunct faculty members, pursuant to a |
71 | supervision plan submitted by the college and approved by the |
72 | board. The plan shall specify the procedures that may be |
73 | performed by interns, the degree of supervision over each |
74 | intern, the number of interns that may be supervised by any one |
75 | faculty member, the qualifications required for faculty members |
76 | to participate in the program, the legal liability for the acts |
77 | or omissions of the intern, and such other matters as the board |
78 | requires by rule. |
79 | (5) A college of chiropractic operating a college-based |
80 | internship program shall annually report to the board the names |
81 | and license or certificate numbers of all faculty members |
82 | participating in the program. |
83 | (6) The board shall adopt rules pursuant to ss. 120.536(1) |
84 | and 120.54 to implement this section. |
85 | Section 3. This act shall take effect upon becoming a law. |
