A bill to be entitled
2An act relating to chiropractic education; amending s.
3400.9905, F.S.; providing that pt. XIII of ch. 400, F.S.,
4the Health Care Clinic Act, does not apply to clinical
5facilities affiliated with certain chiropractic colleges;
6creating s. 460.4064, F.S.; providing legislative intent;
7authorizing chiropractic college-based internships;
8providing eligibility requirements for registration of
9chiropractic interns; providing requirements for approval
10of chiropractic college-based internship programs;
11requiring an annual report to the Board of Chiropractic
12Medicine; requiring the board to adopt implementing rules;
13providing an effective date.

15Be It Enacted by the Legislature of the State of Florida:
16
17     Section 1.  Paragraph (j) is added to subsection (4) of
18section 400.9905, Florida Statutes, to read:
19     400.9905  Definitions.--
20     (4)  "Clinic" means an entity at which health care services
21are provided to individuals and which tenders charges for
22reimbursement for such services, including a mobile clinic and a
23portable equipment provider. For purposes of this part, the term
24does not include and the licensure requirements of this part do
25not apply to:
26     (j)  Clinical facilities affiliated with a college of
27chiropractic accredited by the Council on Chiropractic Education
28at which training is provided for chiropractic students.
29     Section 2.  Section 460.4064, Florida Statutes, is created
30to read:
31     460.4064  Chiropractic college-based internships;
32registration of participating chiropractic interns.--
33     (1)  It is the intent of the Legislature to authorize and
34encourage the participation of chiropractic students in
35internship programs based in clinics associated with colleges of
36chiropractic accredited by the Council on Chiropractic
37Education. Such chiropractic college-based internships are an
38alternative to the community-based internships provided in s.
39460.402(6).
40     (2)  Any chiropractic student desiring to provide
41chiropractic treatment as a chiropractic intern participating in
42a chiropractic college-based internship program shall apply to
43the department to be registered as a chiropractic intern and
44remit a fee, not to exceed $100, as set by the board. The
45department shall register any applicant the board certifies
46meets the following requirements:
47     (a)  Is at least 21 years of age.
48     (b)  Has not committed any act or offense within or outside
49the state that would constitute the basis for disciplinary
50action under this chapter or chapter 456.
51     (c)  Is not currently under investigation in any state for
52an act or offense that would constitute the basis for
53disciplinary action under this chapter or chapter 456.
54     (3)  Registration under this section is valid for a period
55of 1 year and may be renewed upon payment of a renewal fee, not
56to exceed $100, as set by the board.
57     (4)  A chiropractic student is eligible to register as a
58chiropractic intern under this section only if the chiropractic
59college-based internship program has been approved by the board.
60The board shall approve a chiropractic college-based internship
61program if the program meets the following requirements:
62     (a)  The program shall meet current Council on Chiropractic
63Education standards for consumer protection.
64     (b)  The program shall be an established component of the
65curriculum offered by the college of chiropractic.
66     (c)  The program shall require all interns who participate
67in the program to meet all requirements for internship as
68established by the Council on Chiropractic Education.
69     (d)  The program shall provide for supervision of interns
70by full-time or adjunct faculty members, pursuant to a
71supervision plan submitted by the college and approved by the
72board. The plan shall specify the procedures that may be
73performed by interns, the degree of supervision over each
74intern, the number of interns that may be supervised by any one
75faculty member, the qualifications required for faculty members
76to participate in the program, the legal liability for the acts
77or omissions of the intern, and such other matters as the board
78requires by rule.
79     (5)  A college of chiropractic operating a college-based
80internship program shall annually report to the board the names
81and license or certificate numbers of all faculty members
82participating in the program.
83     (6)  The board shall adopt rules pursuant to ss. 120.536(1)
84and 120.54 to implement this section.
85     Section 3.  This act shall take effect upon becoming a law.
