7400.9905, F.S.; providing that pt. XIII of ch. 400, F.S.,
8the Health Care Clinic Act, does not apply to clinical
9facilities affiliated with certain chiropractic colleges;
10amending s. 460.402, F.S.; providing an exception to
11regulation for chiropractic students participating in
12chiropractic college clinical internships; authorizing the
13Board of Chiropractic Medicine to adopt rules; amending s.
14460.403, F.S.; defining "chiropractic college clinical
15internship"; providing an effective date.

17Be It Enacted by the Legislature of the State of Florida:

19     Section 1.  Paragraph (j) is added to subsection (4) of
20section 400.9905, Florida Statutes, to read:
21     400.9905  Definitions.--
22     (4)  "Clinic" means an entity at which health care services
23are provided to individuals and which tenders charges for
24reimbursement for such services, including a mobile clinic and a
25portable equipment provider. For purposes of this part, the term
26does not include and the licensure requirements of this part do
27not apply to:
28     (j)  Clinical facilities affiliated with a college of
29chiropractic accredited by the Council on Chiropractic Education
30at which training is provided for chiropractic students.
31     Section 2.  Subsection (6) of section 460.402, Florida
32Statutes, is amended to read:
33     460.402  Exceptions.--The provisions of this chapter shall
34not apply to:
35     (6)  A chiropractic student enrolled in a chiropractic
36college accredited by the Council on Chiropractic Education and
37participating in either:
38     (a)  A community-based internship under the direct
39supervision of a doctor of chiropractic medicine who is
40credentialed as an adjunct faculty member of a chiropractic
41college in which the student is enrolled; or
42     (b)  A chiropractic college clinical internship under the
43direct supervision of a doctor of chiropractic medicine who is a
44full-time, part-time, or adjunct faculty member of a
45chiropractic college located in this state and accredited by the
46Council on Chiropractic Education and who holds a current,
47active Florida chiropractor's license. The board may adopt rules
48as it deems necessary or appropriate to implement this
49paragraph.
50     Section 3.  Subsection (4) of section 460.403, Florida
51Statutes, is amended to read:
52     460.403  Definitions.--As used in this chapter, the term:
53     (4)(a)  "Community-based internship" means a program in
54which a student enrolled in the last year of a chiropractic
55college accredited by the Council on Chiropractic Education is
56approved to obtain required pregraduation clinical experience in
57a chiropractic clinic or practice under the direct supervision
58of a doctor of chiropractic medicine approved as an adjunct
59faculty member of the chiropractic college in which the student
60is enrolled, according to the teaching protocols for the
61clinical practice requirements of the college.
62     (b)  "Chiropractic college clinical internship" means a
63program in which a student enrolled in a chiropractic college
64located in this state and accredited by the Council on
65Chiropractic Education obtains clinical experience pursuant to
66the chiropractic college's curriculum in a classroom or
67chiropractic clinic operated by the chiropractic college,
68according to the teaching protocols for the clinical practice
69requirements of the college.
70     Section 4.  This act shall take effect upon becoming a law.
