5An act relating to chiropractic education; amending s.
6400.9905, F.S.; providing that pt. XIII of ch. 400, F.S.,
7the Health Care Clinic Act, does not apply to clinical
8facilities affiliated with certain chiropractic colleges;
9amending s. 460.402, F.S.; providing an exception to
10regulation for chiropractic students participating in
11chiropractic college clinical internships; amending s.
12460.403, F.S.; defining "chiropractic college clinical
13internship"; providing an effective date.

15Be It Enacted by the Legislature of the State of Florida:
16
17     Section 1.  Paragraph (j) is added to subsection (4) of
18section 400.9905, Florida Statutes, to read:
19     400.9905  Definitions.--
20     (4)  "Clinic" means an entity at which health care services
21are provided to individuals and which tenders charges for
22reimbursement for such services, including a mobile clinic and a
23portable equipment provider. For purposes of this part, the term
24does not include and the licensure requirements of this part do
25not apply to:
26     (j)  Clinical facilities affiliated with a college of
27chiropractic accredited by the Council on Chiropractic Education
28at which training is provided for chiropractic students.
29     Section 2.  Subsection (6) of section 460.402, Florida
30Statutes, is amended to read:
31     460.402  Exceptions.--The provisions of this chapter shall
32not apply to:
33     (6)  A chiropractic student enrolled in a chiropractic
34college accredited by the Council on Chiropractic Education and
35participating in either:
36     (a)  A community-based internship under the direct
37supervision of a doctor of chiropractic medicine who is
38credentialed as an adjunct faculty member of a chiropractic
39college in which the student is enrolled; or
40     (b)  A chiropractic college clinical internship under the
41direct supervision of a doctor of chiropractic medicine who is a
42full-time, part-time, or adjunct faculty member of a
43chiropractic college located in this state and accredited by the
44Council on Chiropractic Education and who holds a current,
45active Florida chiropractor's license.
46     Section 3.  Subsection (4) of section 460.403, Florida
47Statutes, is amended to read:
48     460.403  Definitions.--As used in this chapter, the term:
49     (4)(a)  "Community-based internship" means a program in
50which a student enrolled in the last year of a chiropractic
51college accredited by the Council on Chiropractic Education is
52approved to obtain required pregraduation clinical experience in
53a chiropractic clinic or practice under the direct supervision
54of a doctor of chiropractic medicine approved as an adjunct
55faculty member of the chiropractic college in which the student
56is enrolled, according to the teaching protocols for the
57clinical practice requirements of the college.
58     (b)  "Chiropractic college clinical internship" means a
59program in which a student enrolled in a chiropractic college
60located in this state and accredited by the Council on
61Chiropractic Education obtains clinical experience pursuant to
62the chiropractic college's curriculum in a classroom or
63chiropractic clinic operated by the chiropractic college,
64according to the teaching protocols for the clinical practice
65requirements of the college.
66     Section 4.  This act shall take effect upon becoming a law.
