    30-594B-05

1 (1) At all elections, a voter claiming to be properly

2 registered and eligible to vote in the county and eligible to

3 vote at the precinct in the election, but whose eligibility

4 cannot be determined, and other persons specified in the code

5 shall be entitled to vote a provisional ballot. A provisional

6 ballot may be cast only for a national, statewide, or

7 countywide office or an office the territorial jurisdiction of

8 which encompasses more than one county and includes the whole

9 of the county in which the voter resides. Once voted, the

10 provisional ballot shall be placed in a secrecy envelope and

11 thereafter sealed in a provisional ballot envelope. The

12 provisional ballot shall be deposited in a ballot box. All

13 provisional ballots shall remain sealed in their envelopes for

14 return to the supervisor of elections. The department shall

15 prescribe the form of the provisional ballot envelope.

16 (2)(a) The county canvassing board shall examine each

17 provisional ballot envelope to determine if the person voting

18 that ballot was entitled to vote at the precinct where the

19 person cast a vote in the election and that the person had not

20 already cast a ballot in the election.

21 (b)1. If it is determined that the person was

22 registered and entitled to vote in the county at the precinct

23 where the person cast a vote in the election, the canvassing

24 board shall compare the signature on the provisional ballot

25 envelope with the signature on the voter's registration and,

26 if it matches, shall count the ballot.

27 2. If it is determined that the person voting the

28 provisional ballot was not registered or entitled to vote in

29 the county at the precinct where the person cast a vote in the

30 election, the provisional ballot shall not be counted and the

31 ballot shall remain in the envelope containing the Provisional

                                  3

1 Ballot Voter's Certificate and Affirmation and the envelope

2 shall be marked "Rejected as Illegal."

3 Section 2. Section 101.2401, Florida Statutes, is

 4 created to read:

 5 101.2401 Voting booths; number; locations.--The

6 supervisor of elections shall provide one voting booth for

7 each 125 registered electors in the county. The supervisor

8 shall provide for assigning a number of voting booths to each

9 polling place based on the number of registered electors of

10 the precinct or precincts served thereby. However, when

11 assigning voting booths to any early voting site used in that

12 county, the supervisor may assign a lesser number, taking into

13 account that early voting is conducted over an extended period

14 and that designation of early voting sites may not correspond

15 to the designation of precincts within the county. The

16 supervisor must have a plan to promptly assign additional

17 voting booths to an early voting site at which the number of

18 voters is such that the voters will not be efficiently served

19 by the number of voting booths originally assigned.

20 Section 3. Paragraph (a) of subsection (4) of section

21 101.5612, Florida Statutes, is amended to read:

22 101.5612 Testing of tabulating equipment.--

23 (4)(a)1. For electronic or electromechanical voting

24 systems configured to include electronic or electromechanical

25 tabulation devices which are distributed to the precincts, all

26 or a sample of the devices to be used in the election shall be

27 publicly tested. With respect to devices that are distributed

28 to early voting sites, all such devices must be tested, and

29 those having an error in tabulation must be replaced with

30 devices passing the test. If a sample is to be tested, the

31 sample shall consist of a random selection of at least 5

1 percent of the devices for an optical scan system or 2 percent

2 of the devices for a touchscreen system or 10 of the devices

3 for either system, as applicable, whichever is greater. The

4 test shall be conducted by processing a group of ballots,

5 causing the device to output results for the ballots

6 processed, and comparing the output of results to the results

7 expected for the ballots processed. The group of ballots shall

8 be produced so as to record a predetermined number of valid

9 votes for each candidate and on each measure and to include

10 for each office one or more ballots which have activated

11 voting positions in excess of the number allowed by law in

12 order to test the ability of the tabulating device to reject

13 such votes.

14 2. If any tested tabulating device is found to have an

15 error in tabulation, it shall be deemed unsatisfactory. For

16 each device deemed unsatisfactory, the canvassing board shall

17 take steps to determine the cause of the error, shall attempt

18 to identify and test other devices that could reasonably be

19 expected to have the same error, and shall test a number of

20 additional devices sufficient to determine that all devices

21 are satisfactory. Upon deeming any device unsatisfactory, the

22 canvassing board may require all devices to be tested or may

23 declare that all devices are unsatisfactory.

24 3. If the operation or output of any tested tabulation

25 device, such as spelling or the order of candidates on a

26 report, is in error, such problem shall be reported to the

27 canvassing board. The canvassing board shall then determine if

28 the reported problem warrants its deeming the device

29 unsatisfactory.
