A bill to be entitled
2An act relating to a review under the Open Government
3Sunset Review Act; amending s. 311.13, F.S., which
4provides a public records exemption for seaport security
5plans of a seaport authority created by act of the
6Legislature or of a seaport department of a county or
7municipality that operates an international seaport;
8removing the October 2, 2005, repeal thereof scheduled
9under the Open Government Sunset Review Act; making
10editorial changes; providing an effective date.

12Be It Enacted by the Legislature of the State of Florida:

14     Section 1.  Section 311.13, Florida Statutes, is amended to
15read:
16     311.13  Certain information exempt from
17disclosure.--Seaport security plans of a seaport authority
18created by act of the Legislature or of a seaport department of
19a county or municipality that operates an international seaport
20are exempt from provisions of s. 119.07(1) and s. 24(a), Art. I
21of the State Constitution. In addition, photographs, maps,
22blueprints, drawings, and similar materials that depict critical
23seaport operating facilities are exempt from the provisions of
24s. 119.07(1) and s. 24(a), Art. I of the State Constitution, to
25the extent that a seaport authority created by act of the
26Legislature or a seaport department of a county or municipality
27that operates a seaport reasonably determines that such items
28contain information that is not generally known and that could
29jeopardize the security of the seaport; however, information
30relating to real estate leases, layout plans, blueprints, or
31information relevant thereto, is not to be included in this
32exemption. The exemptions in this section are applicable only to
33records held by a seaport authority created by act of the
34Legislature or to records of a county or municipal seaport
35department that operates a seaport. The exemptions contained in
36this section are subject to the Open Government Sunset Review
37Act of 1995, in accordance with s. 119.15, and this section
38shall stand repealed on October 2, 2005, unless reviewed and
39saved from repeal through reenactment by the Legislature.
40     Section 2.  This act shall take effect October 1, 2005.
