11 The Committee on Regulated Industries (Aronberg) recommended
12 the following amendment to amendment (822576):

14 Senate Amendment (with title amendment)
15 On page 2, line 11, through page 3, line 11, delete
16 those lines
17
18 and insert:
19 (l) "Swimming pool/spa servicing contractor" means a
20 contractor whose scope of work involves, but is not limited
21 to, the repair and servicing of any swimming pool, or hot tub
22 or spa, whether public or private, or otherwise, regardless of
23 use. The scope of work includes the repair or replacement of
24 existing equipment, any cleaning or equipment sanitizing which
25 requires at least a partial disassembling, excluding filter
26 changes, and the installation of new pool/spa equipment,
27 interior refinishing, the reinstallation or addition of pool
28 heaters, the repair or replacement of all perimeter piping and
29 filter piping, the repair of equipment rooms or housing for
30 pool/spa equipment, and the substantial or complete draining
31 of a swimming pool, or hot tub or spa, for the purpose of any

1 repair or renovation. The scope of such work does not include
2 direct connections to a sanitary sewer system or to potable
3 water lines. The installation, construction, modification,
4 substantial or complete disassembly, or replacement of
5 equipment permanently attached to and associated with the pool
6 or spa for the purpose of water treatment or cleaning of the
7 pool or spa requires licensure; however, the usage of such
8 equipment for the purposes of water treatment or cleaning
9 shall not require licensure unless the usage involves
10 construction, modification, substantial or complete
11 disassembly, or replacement of such equipment. Water treatment
12 that does not require such equipment does not require a
13 license. In addition, a license shall not be required for the
14 cleaning of the pool or spa in any way that does not affect
15 the structural integrity of the pool or spa or its associated
16 equipment.
