11  The Committee on Health Care (Fasano) recommended the
12  following amendment:
13  
14         Senate Amendment (with title amendment) 
15         On page 1, line 21,
16  
17  insert:  
18         Section 1.  Present subsection (3) of section 381.005,
19  Florida Statutes, is redesignated as subsection (4), and a new
20  subsection (3) is added to that section, to read:
21         381.005  Primary and preventive health services.--
22         (3)  Between October 1, or earlier if the vaccination
23  is available, and February 1 of each year, subject to the
24  availability of an adequate supply of the necessary vaccine,
25  each assisted living facility licensed under chapter 400 that
26  has 11 or more residents shall implement a program to offer
27  immunizations against influenza viruses to all residents who
28  are age 65 or older, in accordance with the recommendations of
29  the Advisory Committee on Immunization Practices of the United
30  States Centers for Disease Control and Prevention and subject
31  to the clinical judgment of the responsible practitioner. By

 1  September 1 of each year, the department shall send to each
 2  assisted living facility covered by this section a reminder
 3  notice of the responsibilities of each assisted living
 4  facility under this section.

10  And the title is amended as follows:
11         On page 1, line 2, after the semicolon,
12  
13  insert:
14         amending s. 381.005, F.S.; requiring certain
15         assisted living facilities to offer
16         immunizations against influenza viruses to
17         residents age 65 or older; requiring the
18         Department of Health to notify assisted living
19         facilities by a specified date of the
20         facilities responsibilities;
