11  The Committee on Health Care (Fasano) recommended the
12  following substitute for amendment (764894):
13  
14         Senate Amendment (with title amendment) 
15         On page 1, line 22, through
16            page 2, line 4, delete those lines
17  
18  and insert:  
19         Section 1.  Present subsection (3) of section 381.005,
20  Florida Statutes, is redesignated as subsection (4), and a new
21  subsection (3) is added to that section, to read:
22         381.005  Primary and preventive health services.--
23         (3)  Between October 1 of each year, or earlier if the
24  vaccination is available, and February 1 of the following
25  year, subject to the availability of an adequate supply of the
26  necessary vaccine, each assisted living facility licensed
27  under chapter 400 which has 11 or more residents shall
28  implement a program to offer immunizations against influenza
29  viruses to all residents who are age 65 or older, in
30  accordance with the recommendations of the Advisory Committee
31  on Immunization Practices of the United States Centers for

 1  Disease Control and Prevention and subject to the clinical
 2  judgment of the responsible practitioner. By September 1 of
 3  each year, the department shall send to each assisted living
 4  facility covered by this section a reminder notice of the
 5  responsibilities of each assisted living facility under this
 6  section.
