3 400.426, F.S.; requiring assisted living
4 facilities to implement a program to offer
5 immunizations to residents against influenza
6 viruses; amending s. 1003.22, F.S.; requiring
7 each district school board and the governing
8 authority of each private school to provide
9 information concerning meningococcal disease
10 and its vaccine to parents; requiring the
11 Department of Health to adopt rules specifying
12 the age or grade level of students for whom
13 such information will be provided; requiring
14 each district school board and the governing
15 authority of each private school to determine
16 the means and method for the provision of
17 information regarding meningococcal disease to
18 parents; providing an effective date.

20 Be It Enacted by the Legislature of the State of Florida:
21
22 Section 1. Subsection (13) is added to section
23 400.426, Florida Statutes, to read:
24 400.426 Appropriateness of placements; examinations of
25 residents.--
26 (13) Between October 1, or earlier if the vaccine is
27 available, and February 1 of each year, subject to the
28 availability of an adequate supply of the necessary vaccine,
29 each assisted living facility licensed pursuant to this part
30 shall implement a program to offer immunizations against
31 influenza viruses to all residents who are 65 of age or older,

1 in accordance with the recommendations of the Advisory
2 Committee on Immunization Practices of the United States
3 Centers for Disease Control and Prevention and subject to the
4 clinical judgment of the responsible practitioner.
5 Section 2. Subsection (10) of section 1003.22, Florida
6 Statutes, is amended to read:
7 1003.22 School-entry health examinations; immunization
8 against communicable diseases; exemptions; duties of
9 Department of Health.--
10 (10) Each district school board and the governing
11 authority of each private school shall:
12 (a) Refuse admittance to any child otherwise entitled
13 to admittance to kindergarten, or any other initial entrance
14 into a Florida public or private school, who is not in
15 compliance with the provisions of subsection (4).
16 (b) Temporarily exclude from attendance any student
17 who is not in compliance with the provisions of subsection
18 (4).
19 (c) Provide detailed information concerning the
20 causes, symptoms, and transmission of meningococcal disease;
21 the risks associated with meningococcal disease; and the
22 availability, effectiveness, and known contraindications of
23 any required or recommended vaccine against meningococcal
24 disease to every student's parent, in accordance with the
25 recommended ages of students determined by the Department of
26 Health to be appropriate for the administration of such
27 vaccine. The Department of Health shall adopt rules that
28 specify the age or grade level of students for whom such
29 information shall be provided, consistent with the
30 recommendations of the Advisory Committee on Immunization
31 Practices of the United States Centers for Disease Control and

1 Prevention concerning the appropriate age for the
2 administration of the vaccine, and shall make available
3 information concerning the causes, symptoms, and transmission
4 of meningococcal disease; the risks associated with
5 meningococcal disease; and the availability, effectiveness,
6 and known contraindications of any required or recommended
7 vaccine to school districts and the governing authorities of
8 each private school. Each district school board and the
9 governing authority of each private school shall determine the
10 means and methods for the provision of such information to
11 students' parents.
12 Section 3. This act shall take effect July 1, 2005.
