2 An act relating to immunizations; amending s.
3 381.005, F.S.; requiring certain assisted
4 living facilities to offer immunizations
5 against influenza viruses to residents age 65
6 or older; requiring the Department of Health or
7 its designee to notify assisted living
8 facilities by a specified date of the
9 facilities' responsibilities; amending s.
10 1003.22, F.S.; requiring each district school
11 board and the governing authority of each
12 private school to provide information
13 concerning meningococcal disease and its
14 vaccine to parents; requiring the Department of
15 Health to adopt rules specifying the age or
16 grade level of students for whom such
17 information will be provided; requiring each
18 district school board and the governing
19 authority of each private school to determine
20 the means and method for the provision of
21 information regarding meningococcal disease to
22 parents; providing an effective date.

24 Be It Enacted by the Legislature of the State of Florida:
25
26 Section 1. Present subsection (3) of section 381.005,
27 Florida Statutes, is redesignated as subsection (4), and a new
28 subsection (3) is added to that section, to read:
29 381.005 Primary and preventive health services.--
30 (3) Between October 1 of each year, or earlier if the
31 vaccination is available, and February 1 of the following

1 year, subject to the availability of an adequate supply of the
2 necessary vaccine, each assisted living facility licensed
3 under chapter 400 which has 11 or more licensed beds shall
4 implement a program to offer immunizations against influenza
5 viruses to all residents who are age 65 or older, in
6 accordance with the recommendations of the Advisory Committee
7 on Immunization Practices of the United States Centers for
8 Disease Control and Prevention and subject to the clinical
9 judgment of the responsible practitioner. By September 1 of
10 each year, the department or its designee shall send to each
11 assisted living facility covered by this section a reminder
12 notice of the responsibilities of each assisted living
13 facility under this section.
14 Section 2. Subsection (10) of section 1003.22, Florida
15 Statutes, is amended to read:
16 1003.22 School-entry health examinations; immunization
17 against communicable diseases; exemptions; duties of
18 Department of Health.--
19 (10) Each district school board and the governing
20 authority of each private school shall:
21 (a) Refuse admittance to any child otherwise entitled
22 to admittance to kindergarten, or any other initial entrance
23 into a Florida public or private school, who is not in
24 compliance with the provisions of subsection (4).
25 (b) Temporarily exclude from attendance any student
26 who is not in compliance with the provisions of subsection
27 (4).
28 (c) Provide detailed information concerning the
29 causes, symptoms, and transmission of meningococcal disease;
30 the risks associated with meningococcal disease; and the
31 availability, effectiveness, and known contraindications of

1 any required or recommended vaccine against meningococcal
2 disease to every student's parent, in accordance with the
3 recommended ages of students determined by the Department of
4 Health to be appropriate for the administration of such
5 vaccine. The Department of Health shall adopt rules that
6 specify the age or grade level of students for whom such
7 information shall be provided, consistent with the
8 recommendations of the Advisory Committee on Immunization
9 Practices of the United States Centers for Disease Control and
10 Prevention concerning the appropriate age for the
11 administration of the vaccine, and shall make available
12 information concerning the causes, symptoms, and transmission
13 of meningococcal disease; the risks associated with
14 meningococcal disease; and the availability, effectiveness,
15 and known contraindications of any required or recommended
16 vaccine to school districts and the governing authorities of
17 each private school. Each district school board and the
18 governing authority of each private school shall determine the
19 means and methods for the provision of such information to
20 students' parents.
21 Section 3. This act shall take effect July 1, 2005.

COMMITTEE SUBSTITUTE FOR

26 The committee substitute makes the following changes:
27 - Amends s. 381.005, F.S., instead of s. 400.426, F.S.,
to require assisted living facilities (ALFs) with 11 or
28 more licensed beds to offer flu vaccines to residents who
are age 65 or older. The ALFs must offer the vaccines
29 between October of each year and February of the
following year.

-Requires the Department of Health or its designee to
31 send ALFs information related to immunizations.
